The Choma Magistrate Court has sentenced the man who was caught behind an Ant hill in the process of having sexual intercourse with another man’s wife to Six months imprisonment with hard labour.
This is in a case in which Harold Malumo of Hachizibe village of Batoka assaulted McLeans Malambo a farmer of the same village when he caught his wife and the accused in the process of having sexual intercourse behind an Ant hill on the 17 September, 2017.
Byta FM Court beat specialist reports that the Court established that the accused was indeed in an adulterous affair with Astridah Munkombwe the complainant’s wife and that the two were truly caught in the act by McLeans Malambo who pursued them and was badly stoned and bitten on his thumb by the accused after he apprehended him.
The Court further denied the fact that the accused was acting in self-defense as he never showed the Court where he was battered and neither did he bring witnesses to support his theory.
In mitigation, Malumo asked for the Court’s forgiveness and vowed never to repeat his action as he has small children and looks after his younger siblings and grandmother as his parents are late and that he is ready to compensate the complainant.
In passing judgement, Magistrate Richard Chikalanga considered the fact that the accused was the first offender and looked remorseful, but his conduct was pathetic as he wondered how he could beat up a man after having sexual intercourse with his wife.
He therefore, sentenced the accused to Six months imprisonment with hard labour effective 19th January, 2018.
Earlier this month, the Choma Magistrate Court room was left in stitches when Malambo said he saw his wife undress in front of another man behind an Ant hill.
He narrated that on 17th September, 2017 his wife left home to go and look for some Okra in the bush but he followed without her knowledge.
He explained that while he hid in the nearby bushes, he then saw his wife with another man as they sat behind an Ant hill.
Malambo graphically explained that after a short time, his wife Astridah Munkombwe removed her underwear and spread a Chitenge on the ground and lay on it.
Malambo said at that moment, he then made noises just as his wife and Malumo were about to start having sex.
The two, according to Malambo scampered in different directions but he managed to apprehend the accused who fought him badly and bit him on his right thumb.
Malambo was however rescued by a Headman who lived nearby.
Malambo’s wife admitted to having sexual intercourse with Malumo on two occasions with the first time being at State Ranch Farms around 14:00Hours.
The revelation sent the court room into hysterical laughter forcing the Prosecutor to send out four men for failing to control their excitement.
