RETIRED Lusaka High Court judge Prisca Nyambe has sued her tenant in the High Court demanding payment of K18,000 as rentals for her house in Chawama Township.
In this matter, judge Nyambe SC, has sued Cephas Salimbuchi and seeks leave from the High Court that she should be issued warrant of distress and take possession of her property at Stand No 19/block 75 Chawama.
According to an affidavit in support of ex parte originating notice of motion for an order for leave to issue warrant of distress and possession of stand No. 19/ Block 75 Chawama filed in the principal registry, judge Nyambe stated that Salimbuchi has refused to pay her rent from the time he took possession of the property and that he has sublet the premises without her permission.
“The respondent is my tenant in the said house and he has been in occupation for a period of exceeding three years. The lease was on verbal terms as it was intended that he would only stay in the property for a period not exceeding three months,” she stated.
The judge stated that Salimbuchi was supposed to be paying monthly rental of K500 but has been owing for three years.
Judge Nyambe is seeking an order to recover her money and wants Salimbuchi to vacant the house and that he should bear the costs of the court proceedings.
