Student Seeks Divorce From “Adulterous” Wife

A LAW student has pleaded with the Lusaka High Court to dissolve his marriage of 10 years claiming that his wife is adulterous and that the marriage has broken down irretrievably.

According to documents filed in court, James Banda dragged his wife Sibongile Sibande Banda to court for divorce saying the two had lived apart from December 31, 2016 and that they had no children.

Mr Banda said that when he lost employment and could not afford to pay rent, he asked his wife to follow him to his mother’s place but she refused and opted to stay with her friends.

He said, however, that they later relocated to Kaunda Square where his wife started patronising night clubs and misbehaving.

Mr Banda said that at some point, his wife asked to go for overnight prayers, only to be called by his friend that his wife was at a night club drinking, adding that when he went to see for himself, he indeed found her but she threw beer bottles at him when he approached her and asked him to stop following her.

He said because of his love for her, he engaged a pastor together with her relatives and during meetings she confessed her alleged bad behaviour.

On December 31, 2016 they were re-united at church and had an anniversary but that two weeks later, his wife asked her friends to ask him if she could spend a night at their home, Mr Banda said.

He also said that at some point when he went through her phone, he found a recorded audio of her talking to her boyfriend with words of love.

Mr Banda now wants the court to grant him divorce saying that his love for her has diminished owing to his wives’ alleged adulterous behaviour.

The case is awaiting allocation to a judge where it will be heard and determined.
