Businessman Sues PF Councillor Over K56,780

PF Ibolelo ward councillor Staivous Mulumba has been sued in the Lusaka High Court by a businessman who is demanding immediate payment of K56,780.
The claim stems from supply of white maize, building materials, and cash.
According to a statement of claim filed in court, Arnold Chande is claiming immediate payment of the money for the cost of 369 by 50 kilogramme bags of white maize, iron sheets and other building materials and cash he gave Mulumba on request.
Chande is also claiming specific performance of the contract of sale of a plot at a consideration of K7,500 situated in Ndola, damages for breach of the contract, interest in the sums due, costs and any other reliefs the court might deem fit.
The plaintiff stated that sometime in April 2015, he entered into a sale agreement with Mulumba for 369 by 50 kgs of white maize and a piece of land in Ndola.
Chande stated that it was expressly agreed that the selling price for white maize was K48 per 50 kg and K16,300 was paid to Mulumba.
Chande further stated that due to non-delivery of the consignment by the defendant for one year, it was later agreed that the selling price for a 50 Kg bag of maize be increased to K120 bringing the total debt to K44,280.
He stated that the defendant requested to be advanced with K5,000 which was to be added to the existing debt and that it would be settled together.
Chande further said the defendant was additionally paid K7,500 as cost of his piece of land in Ndola.
