State Closes Tokota Boys Case

The State has closed its case against 19 suspected Tokota Boys accused of kidnapping, poisoning and acts intended to cause grievous harm.
And the defence team representing the suspects wants to file written submissions to the court before the ruling on case or no case to answer is made.
Acting assistant chief State advocate Mercy Pondamali-Lungu told Kitwe High Court Judge Timothy Katanekwa yesterday that the State will not call any more witnesses in the aforementioned cases.

This was after the defence and the State finished cross-examining and re-examining the police officer.
“This marks the close of the State’s case. We will not call the other witnesses that were on our deposition list,” Mrs Pondamali-Lungu said.
And Justice Katanekwa urged the defence team to file their written submissions on or before September 14, while the State was told to file their reply on or before September 21, this year.

Justice Katanekwa adjourned the matter to his October session for ruling and possible defence.

Meanwhile, authorities from Kamfinsa Correctional Facility told Justice Katanekwa that the two accused persons whose age is supposed to be determined medically will be taken to the hospital on Monday. This was after the defence sought clarity on why the State had not taken the two affected suspects for medical examination despite the court ordering that they do so.

A prison officer, Tom Sitwala, said the specialist doctor in age determination was out of station and will only be back on Monday.mEarlier, Judge Katanekwa had ruled that the second and fourth accused persons in the matter undergo medical examination to determine their age following submissions by their parents that they are juveniles.

This is in a case Limbikani Phiri, Musonda Semba, Davy Kateta, Lucky Mwaba, Wisdom Chilekwa, Bill Mulenga, Moses Chilambe, Boniface Lubansa, Wensy Chilembo and Richard Siame are charged with kidnapping, acts intended to cause grievous harm and poisoning.
Others are Lazarus Zulu, Kingsley Ng’ona, Abaraham Sikazwe, Teddy Chilufya, Bernard Phiri, Sydney Kasase, Doctor Simweemba, Mills Mumba and Trust Sinkala.
