The studen  who has been sued by Legana Investment Limited for claiming that she found a condom in the sausage has said that the product is delicious, but has maintained her claims. This is in a case Legana Investment Limited has sued Luyando Kopakopa, a medical student, and her lover, Eric Ng’andu, for defamation.

The meat company sued the duo claiming damages for defamation of character arising from a libellous publication of false allegations that it produces sausages contaminated with human flesh and condoms. A video went viral in which Ms Kopakopa was filmed claiming that she suffered nausea and vomited after consuming an allegedly contaminated Legana sausage.

Legana sued her demanding exemplary and special damages contending that the meat company’s business has suffered special damages due to a heavy reduction in the sales of its products country wide. But Ms Kopakopa is also counter-claiming for damages for mental anguish and stress from Legana Investment Limited.

She contends in her defence that she suffered stress at the sight of the alleged condom that she found in a purported Legana Hungarian sausage. Ms Kopakopa, however, submits that she has been eating Legana sausages for a long time, and that they are delicious. She, however, states that last month, she ate part of Legana sausage and later started feeling sick.

“After eating part of the plaintiff’s [Legana] sausage, the second defendant [Kopakopa] suffered damage,” she submitted. And Mr Ng’andu submitted that on August 3 this year, he bought a kilogramme of Legana sausages from a supermarket at Makeni Mall. “On August 6, Mr Ng’andu requested Ms Kopakopa, who had come to visit him, as his ‘lady friend’, to prepare the sausages and he carried some cooked sausages which he ate elsewhere and enjoyed it, “ the submissions read.

He states that Ms Kopakopa later called him and explained that after eating one of the sausages, she observed that it had what looked like an elastic ring, and further looked like an amputated manhood. Mr Ngándu contended that the strange sausage caused Ms Kopakopa to vomit and she had to seek medical attention for two days. The two have argued that the alleged defamatory words complained of by Legana are a fair comment because the issue was of public interest.
