A SIXTY-YEAR-OLD man of Kapiri Mposhi will probably spend the rest of the remaining days of his life in prison after being jailed for 40 years for defiling a nine-year-old girl. And before the same court, an 18-year-old juvenile of Mumbwa who killed his uncle two years ago while in a state of insanity will be detained at the President’s pleasure. Kabwe High Court Judge in charge Kelvin Limbani told Greenwill Tembo, the defiler, that he deserves to be punished for sexually abusing the girl and leaving her traumatised.
“Your actions deserve punishment so that you can reflect and hopefully reform and be deterred from committing other offences,” Judge Limbani told Tembo. Tembo was sentenced on Thursday after being found guilty of defiling the girl on May 13 this year. Tembo first appeared before the Kapiri Mposhi Magistrate’s Court, which committed him to the Kabwe High Court for sentencing. Judge Limbani said he was satisfied with the proceedings of the Kapiri Mposhi Magistrate’s Court.
The court heard that on the day, Tembo waylaid the girl as she was returning home from having her hair plaited. He grabbed her and took her to his house, where he abused her. Tembo threw his victim out of his house after defiling her. “You threatened to beat her and you threw her out of the house,” Judge Limbani said. He said at the age of 60, it is unthinkable that Tembo defiled a nine-year-old girl who was like a granddaughter to him. He said in a normal situation, he was expected to protect the girl but he took advantage of her and abused her trust.
He said looking at Tembo’s age, he has had a large share of life to know what is wrong and right and as a result of the offence he committed, he deserved punishment. And before the same court, an 18-year-old juvenile of Mumbwa who killed his uncle two years ago while in a state of insanity will be detained at the President’s pleasure. Judge Limbani issued the directive on Thursday when the juvenile, who killed his uncle Anderson Mutowa on April 12, 2017, appeared before him. Judge Limbani said at the time the juvenile killed his uncle, he was not in the right frame of mind but in the state of insanity. Judge said much as the court found him guilty of murder, he was behaving in a strange manner before, during and
