Adulterer Ordered To Pay K7,000

A FARMER of Livingstone has been sued for adultery after confessing to having sex with another man’s wife in the bush. Darius Sikabbuba, 27, also a farmer of Sinde village in Livingstone, told the local court that he wants Colleen Sindokile, 29, to pay him K20,000 as compensation for committing adultery with his wife. Sikabbuba told principal local court presiding magistrate Mubita Mubiana that he married his wife Belita Phiri, 23, after paying three animals. “ M y f r i e n d B i g g i e Muhandika, 26, found Sindokile having sex with my wife in the bush. When I heard I dragged the duo to the police where they admitted having sex, saying they were lovers. The police advised me to sue,” he said.

And Muhandika testified that he found Sindokile and Phiri having sex in the bush and reported them to the police. In defence, Sindokile refuted the allegations and denied confessing to having an affair with Phiri. But Phiri told the court that the witness, Muhandika, was the one who had proposed love to her. “When I turned him down, he fabricated a story about Sindokile and me having sex in the bush. My confession to the police was done under duress. I only wanted to buy a table from Sindokile,” she said.

Sindokile’s wife, Astridah Muchimba, told the court that there is no love affair between her husband and Phiri. She said there was a business relationship between the two. And a report from the police indicated that Sindokile admitted to having had a sexual relationship with Phiri. The report also indicated that when the two were caught redhanded in the bush, Muhandika also demanded for sex from her in order to keep a secret from her husband.

Passing judgment, the court upheld the adultery claim after establishing that Sikabbuba and Phiri were duly married as dowry was charged and paid. Sindokile was ordered to pay K7,000 as compensation for adultery in monthly instalments of K500
