The technical committee tasked with drafting the new constitution has stated that it was not appointed by the President on the Basis of the Inquiries Act.
Committee spokesperson Simon Kabanda tells QFM that the committee was appointed using Articles 33 and 44 of the constitution which allows the executive to constitute an organ such as a technical committee.
Mr. Kabanda has maintained that the work of the technical committee is not in anyway similar to that of the constitution review commission (CRC) or National constitution Conference.
He says people should therefore not compare the technical committee’s operations to those of the NCC which later failed to produce a document that was to suit the demands of the Zambian people.
Mr. Kabanda has assured that the committee is positive that its outcome will not be frustrated because the PF government has shown political will on the constitution making process.
He observes that this was not the case with the previous MMD government which had to be pushed on the constitution making process.
Some stakeholders have voiced out that there is a possibility that the final report of the technical committee will be rejected because it will have to be submitted to the head of state who in turn will present it to Cabinet for debate

Technical committee is not supposed to receive submissions but to draft the constitution as per the submissions already made to Mungomba, Mvunga and Chona. Bushe tabomfwa abantu? So the idea is to refine the constitution using legal language, remove any repeatitions from the three previous commissions and then take it to parliament for people to debate. First I doubt this person’s statement, this man has no credibility, being in the committee is his first real job in many many years after being dismissed as a catholic priest. His organization was operating from the chairpersons house, secondly, whether the Technical committee was appointed using Articles 33 and 44 of the constitution or through the inquiries act, it does not matter, because the process of adopting the output of the committee ie Report/Recommendations is the same, the president has to receive the document, then cabinet has to decide on the contents and finally a bill to have a referendum or new constitution has to be submitted to parliament for consideration. Most experts said the previous draft constitution that was submitted to parliament not very good, PF did not vote for it merely because it was submitted by the MMD. What we should now check, is to what extent the next bill will be different to the previously presented bill, we should not expect anything less or equal to the previously presented bill, we should should expect a far better constitution than the current and previously present draft bill to parliament.

TC appointed by the the president to draft National Constitution- handing it to the president for ammendements or verification- taking it to Cabinate appointed by the president for debate. Does this process make sense to Zambians? This is one man made constitution. Any concerned citizen of Zambia should reject this PF constitution making process. Since the cabinet represent the president they will not say no to any law that the president will endorse. The Technical Committee was appointed by the president they will also pay their layalty to the presitent that’s why this PF national constitution will be one man made not a national one. Zambia is back to KK’s time of one man control of Zambia where anyone with anything expensive item was was considered as an enemy or a thief and investigated. Sata will make sure to intice opposition MPs to Join PF or accept appointmets in order for PF to have more supporters in parliament. If he will be succeeful to have more opposition MPs SUPPOTERS he will take the constitution draft to parliament for approval if not he will use the cabinate to approve it.Opposition Mps must make sure that they oppose anything evil from PF.As MPs accept appointments from Sata they will not vote against any evil law such as recocnition of gay’s rights gay. VIVA UPND INCORRUPTABLE MPs.
