Convicted former labour minister Austin Liato has been granted a K50 million cash bail pending appeal to the High court with two working sureties in his own recognisance.
Principal magistrate Aridah Chulu in granting bail this morning also ordered Mr Liato to be reporting to Lusaka Central Police every two weeks.
Magitrate Chulu has further ordered Mr. Liato to surrender his passport to the senior clerk of court.
The former labour minister was last week slapped with a two years jail sentence with hard labour after being found guilty of taking pecuniary advantage of money suspected to be proceeds of crime.
This is in the matter in which Mr Liato was facing one count of being in possession of K2.1 billion suspected of being proceeds of crime contrary to section one (1) of the forfeiture of proceeds of crime Act number 19 of 2010 of the laws of Zambia.
The K2.1 billion was unearthed from the ground at his Mwembeshi farm were he had buried it.
He became the first high-profile figure of the previous MMD Government facing corruption charges to be convicted.

Just release him but let the cash and his farm be taken over by the State. appeals in our judicial system are a waste of time…..they just enrich defence lawyers

well, i expected to read some intelligent comments on this matter. somehow, the high court will have to grapple two constitutional issues i.e. presumption of innocence and the right to remain silent. these are constitutional guarantees and should not have been sacrificed for expedience of subsidiary legislation like the penal code or statutory instrument on forfeture of whatever. magistrate chulu erred in law when she ignored these constitutional issues. maybe it is deliberate cos she knew liato

There is something seriously wrong with our justice system. If you are rich you can spend that five years outside jail and even live in luxury. A classical example of this is that of Kashiwa Bulaya who has spent his five years in high cost hospital bed at UTH and even comes to Manda Hill to do some shopping. On Africa Freedom Day, I actually saw him at Manda Hill! If it was some poor guy with no money to spare, he would have spent the next five years at Chimbokaila struggling to remove lice from his greying head.

A judge works according to the law. If the law states the maximum penalty for a crime, that is what the limit for the judge is.
