ABOUT 200 houses in Lusaka’s Libala South are set for demolition after the court established that the owners have encroached on a piece of land belonging to the Disadvantaged Children Pathfinder Association Trust (DCPAT).
The structures at plot number 33857, commonly known as Yellow Shop, were built in 2006 but would now be razed after a long battle between the squatters and the non-governmental organisation (NGO).
The DCPAT, which holds the title for the piece of land, lost the plot to the political party cadres who subdivided it in 2006. Efforts to reclaim it proved futile until last year when the court ruled in its favour.
In December last year, the High Court ordered the Sherriff of Zambia to give possession of the premises and property to the association.
Zesco is in the process of removing its installations from the area to pave way for the demolition.
DCPAT patron Peter Simpemba said the organisation was ready to execute the order by the court and warned people occupying the houses to vacate before the demolition started.
“We have written to Zesco to remove their installations. They delayed but they have now agreed to remove them so that we can move in. For those that are resisting the warning, it is clear that we are within the law.
“Secondly, this is a lesson that people will not always get away with lawlessness, you cannot buy land on the street. We have been paying land rates for this piece of land without benefiting from it,” Mr Simpemba said.
He said his organisation had given the people enough time to vacate the premises but most of them had remained adamant.
Mr Simpemba said while the organisation realised the inconvenience caused to the affected residents, it was equally a lesson on how people should behave towards other people’s property.
He commended the Patriotic Front (PF) Government for ensuring that issues of land were handled by relevant institutions unlike in the past where cadres took control of the land allocation.
He said his organisation had suffered a great deal after donors withdrew their offer to build a hospital at the same land because of the encroachment by the squatters.
According to the letter by Zesco to the association, the power utility firm has agreed to remove its installations from the affected area within seven working days.
“Kindly take note that we shall fully comply with your request to remove all our installations from the above mentioned plot,” read the letter in part which was signed by a Mrs MW Vukovic, director of legal services.
“We are, therefore, in the process of sending out the requisite notices to our affected customers presently doing business on the plot, informing them to vacate the premises accordingly.”
Land wrangles were rife during the MMD reign, particularly in the past three years when political party cadres fought with landlords as they tried to allocate pieces of land.
Prime pieces of land, including the Baobab on Kafue Road, are under investigation by the Anti-Corruption Commission (ACC) after allegations that it was offered corruptly to an Egyptian investor.

But what is strange is where was the plot owners when people were building? 200 houses do not just spring up in a second. Couldn’t they have stopped the house building process even at foundation or slab levels. Let us also verify property ownership before moving into a piece of land.

PF “MUST” think about the poor zambians who have given them power. Demolishing 200 houses is very traumitizing, as some affected people may end up dying of depression. PF ,Please help the helpless just as you spoke for the voiceless while in opposition. In everything under the earth there are processes and procedures. Even with God, the bible says cleanse yourself and that do not appear before God empty handed. When Marrying there is a procedure, when getting into a school there is procedure, when getting a Job there is procedure, EVEN GOING TO THE TOILET there is procedure.
Getting Land there is procedure and also when developing there is also procedure, Circular 1 of 1985 on Land alienation, the Land act and section 22 of the Town and Country Planning Act CAP 283 of the Laws of Zambia Apply. We must all obey laws of the land. There is a reason why the DCPAT chose that land initially. So I cannot get it from them illegally and then ask GRZ to give DCPAT alternative land – why? Why can’t I take alternative land myself? Do you know how it feels when a policeman tells you that “go and negotiate” with someone who has stolen your cellphone? Negotiate with a thief? What laws are those?

Zambia is corrupt through and through. People seem to use corrupt tendencies to get their way through. This why there are wrangles especiaally in the area of Land Management and allocation. There is need to clean up this mess.Getting a peace of Land for a lay Zambian is a nightmare as those making allocations want to make it seem impossible to achieve. This problem is not only in land allocation but in other sectors such as geeting licences. Those in such insitutions wnat to make seem hard.
