MUVI Television Limited has filed an injunction restraining National Pensions Scheme Authority (NAPSA) or its agents from evicting it from the Levy Business Park in Lusaka.
This is in a matter in which the private television station has dragged NAPSA and Liberty Property Limited to court for wrongful termination of a lease agreement.
Muvi TV wants an order from the Lusaka High Court that the rental charges being quoted in United States dollars by NAPSA was illegal and contrary to the Bank of Zambia (BOZ) currency regulations as contained in Statutory Instrument number 33 of 2012.
The TV station has since demanded an order that it was entitled to occupation of the premises on stand number 27455, being the entire first floor of Levy office block at Levy Business Park.
Muvi TV also wants an alternative order to grant it tenancy of the premises and an order that the purported termination of the lease agreement by NAPSA was a breach of section five of the Act and that the same was null and void.It further demanded for damages for the breach of contract, interest, costs and other relief the court may deem fit.
Muvi TV contended in its affidavit in support of the originating notice of motion sworn in by Alfred Tembo, the administrative director, that on December 23, 2011, NAPSA offered Muvi TV a lease agreement for occupancy and use of the premises.
Mr Tembo said at the time of the offer of lease, Muvi TV was told that the offices were not yet ready for occupancy as there were some alterations that were being undertaken.
He said Muvi TV only managed to collect the keys for the offices on May 21, this year when alterations and modification had not yet been effected.
Mr Tembo said despite the development, NAPSA issued an invoice for rentals dated September 1, 2012.
As the television station was preparing to make payments, NAPSA terminated the lease agreement through a letter dated September 5, 2012 and gave a notice to vacate the premises.
He said by this time, Muvi TV had spent substantial time of human resources and money over the premises.
Mr Tembo said it was illegal for NAPSA to charge his company in dollars because it was contrary to the Zambian laws.

Corporate image is good but it goes with a huge cost and you must be ready to pay for it.Levy Park is good image but its not cheap,whether quoted in kwacha or dollar.You got the keys in May and in Sept that’s when you ‘discovered’ that your rentals are in dollar?As an accountant I advise u to sack your accountant and legal advisor
