Drama as Luanshya Hubby Seeks Separation From ‘Violent Police Wife’
THE Luanshya Magistrate Court has granted a restraining order to Luanshya resident Henry Kanyimbwa, 48, to restrain his wife Stella, a police officer, from living in the family home because she has been battering him.
This is in a case in which Kanyimbwa, a physical trainer of house number 4227 in Mikomfwa, applied for a court order to get his wife out of his home.
Appearing before magistrate Henry Aongola, it was heard that on September 25, 2012, Stella’ who is the respondent in the matter, assaulted her husband who sustained injuries.
Kanyimbwa told the court when the matter came up for hearing at the Luanshya Magistrate Court on Monday that his wife of three years has been battering him for the last two years and he has decided to seek the intervention of the court for his safety.
“I was assaulted by my wife on September 25, 2012 and I sustained multiple injuries and I have a medical report signed by a competent doctor from Thompson Hospital in Luanshya,” Kanyimbwa told the court.
The medical report indicated that the defendant sustained nasal pain, swollen upper lips, hip pain and general body pains after being assaulted by his wife who allegedly used a brick.
Kanyimbwa also testified that on July 28, 2012 his wife attempted to take her life by consuming a pesticide.
He told the court that he wants to be separated from his wife as the couple awaits divorce because he can no longer stand the “violent behaviour and cruelty” of his wife.
“My two biological daughters from my first marriage have run away because of her cruelty…. I have endured pain silently for over two years because my wife always threatens me that “she is the boma” and she is untouchable even if I report her to the police,” Kanyimbwa said.
But Stella, who is an inspector in the traffic section at Baluba Police Station, denied all the allegations levelled against her.
It was later also discovered that Stella allegedly forged a medical report which she presented to the court, to counter her husband’s application for a restraining order.
After investigations, court officials discovered that the medical report was forged.
Stella also surprised the court by producing two marriage certificates, one from the civic centre and one from the United Church of Zambia in Kabwe where the couple got married.
But Kanyimbwa told the court that he is only aware of the marriage certificate from church.
Magistrate Aongola charged Stella with forgery.
Magistrate Aongola set November 27, 2012 for judgment in the case and December 4, 2012 for hearing of the dissolution of the marriage.
