Man Sued For Trying To Rape Step-Daughter

A LUSAKA man has lost his marriage after he attempted to defile his 16-year-old step-daughter on grounds that his wife denied him conjugal rights.

This is a case in which Anipher Mwale, 38, sued her husband, Michael Mwale, of Kanyama Township for divorce because he attempted to defile his step-daughter on several occasions.

Anipher said her 48-year-old husband tried to defile his step-daughter, while she was asleep but she managed to defend herself.

She said their marriage had broken down irretrievably because she did not trust her husband any more after the incidents.

Mwale said the couple had been facing problems in the past but that everything was blown out of proportion after her daughter revealed that her step-father had been making sexual advances at her.

She told magistrates Mable Mwaba and Mary Namangala that the two got married in 2007 and have had one child although she has two other children from her previous marriage.

She said when she confronted her husband, he failed to give a satisfactory explanation on the allegations that he wanted to have sex with his step-daughter.

“This man failed to deny that he wanted to have sex with his step-daughter on grounds that we were having marital disputes in the house,” she said.

Anipher said she took the case to the Human Rights Commission (HRC) who advised her to take the matter to the police which she declined.

But Mwale said the allegations were false, insisting that his step-daughter was just fabricating the story because they were not in good terms.

He said when he went to his step-daughter’s room, he did not want to sleep with her because it was a taboo but he just wanted to ask something.

“I did not want to have sex with my daughter because it is a taboo but I was just asking something since I heard some noise outside at night,” he said.

He told the court that his wife had even reached an extent of trying to bewitch him by attempting to make him mad using charms.

But magistrates Mwaba and Namangala said it was not normal for a man to go into his teenage daughter’s room late at night while her mother was fast asleep.

The magistrates said Mwale’s explanation was vague, which prompted them to dissolve the marriage and ordered him to compensate her K600 in monthly installments of K200, and K150 as child maintenance.

    What a lame excuse “ama daddies”. Should have been locked for a month for premeditated rape.
