A 30-YEAR-OLD man of Lusaka’s Chaisa has been sentenced to death by hanging for abducting, raping and strangling his 17-year-old wife to death.
Lusaka High Court judge Florence Lengalenga pronounced the sentence against Chitalu Musonda, an electrician, of house number 177/14 Chaisa, after finding him guilty of killing his wife, Peggy Sakala, in 2010.
Ms Justice Lengalenga convicted and sentenced Musonda, who is charged with murder contrary to Section 200 of the Penal Code Chapter 87 of the Laws of Zambia, in a judgement delivered in Lusaka yesterday.
“After considering the evidence before me, I accordingly find Chitalu Musonda guilty of the offence of murder contrary to Section 200 of the Penal Code and convict him accordingly.
“I have also taken into consideration the mitigation factors, I have no choice but to give you, Chitalu Musonda, a sentence to hang by the neck until pronounced dead,” she said.
Ms Justice Lengalenga was satisfied that the prosecution had discharged the burden of proof against Musonda and that his evidence was mere fabrication and a falsehood to cover up his acts.
She said there was circumstantial evidence proving Musonda was with Ms Sakala on March 14, 2010, when she went missing.
The judge said Musonda intentionally killed Ms Sakala by strangling her and tied her to a tree to portray as if she was murdered by other people.
Musonda left Ms Sakala in a sitting position in Le Soleil farms and her decomposed body was discovered by farm workers.
Ms Justice Lengalenga said the postmortem carried out by a pathologist from the University Teaching Hospital indicated that Ms Sakala’s private parts had blood due to sexual intercourse and she died of strangulation.
“The circumstantial evidence before this court is very compelling and overwhelming that Chitalu Musonda killed Peggy Sakala by strangling her and tying her to a tree to portray as though she was killed by other people,” she said.
Ms Justice Lengalenga said Musonda’s conduct of being in possession of Ms Sakala’s mobile phone and taking their child to her friend, Justina Banda, proved that he was with the victim on March 14, 2010.

thats good,atleast zambians are now thinking,from now onwards,any case of rape,defilment and molestation its straight away hanging by the balls.no two ways about it.maybe zambia wil develop.

Good judgement indeed but the judge errored a bit he should have instructed the hangerman to hang him by the balls so that they are seperated from the body coz of rape 2ndly the neck for murder that would have been fair.She is bias Anyway cikala aleya
