WHEN parents advise their children not to marry certain men for obvious reasons, children tend to rebel and call them old fashioned.
This was proved true when a 39-year-old woman told the Lusaka Boma Court how she has suffered emotionally at the hands of her abusive husband whom her father advised her against marrying.
Josephine Lwipa told senior court magistrate Sera Nyendwa that she has suffered so much at the hands of her husband, Willbroad Mbao, 54, whom she accused of being a womaniser.
She said her husband has been torturing her emotionally by bringing different women in her home and having sex with them.
“He sometimes used to make love with some of his girlfriends in the car and I could just watch helplessly. Many of his lovers are now dead and he has even infected me with HIV/AIDS because of his promiscuity,” she said.
This was in a case in which Lwipa of Makeni sued Mbao of Livingstone for divorce. They got married in 1995 and have three children together.
Lwipa, who has been on separation with her husband for four years, said she has never enjoyed her marriage of 13 years because her husband has emotionally, physically and financially abused her.
She told the court that whenever she asked for money from her husband, he would tell her to do prostitution saying he could not waste his money on her as she is not woman enough.
“He tells me that there are sweet women out there and that he married me because he only wanted me to give him children but not out of love,” Lwipa said.
She said her father warned her against marrying Mbao and told her not to run to him when things went wrong in their marriage.
Lwipa said she opted to tell her husband’s relatives about their marital problems, who only advised her to be strong.
She said she had no say in their marriage as her husband used to make all the decisions and buying food in the home, including tomatoes.
“He used to tell me that he can even marry 10 wives and no one can stop him because I’m not even his first wife but the third one,” Lwipa said.
She said her husband used to beat her until she became unconscious and used to hurl all sorts of insults at her in front of her children and neighbours.
Lwipa said her husband has abandoned their 17-year-old child and stopped paying for his education when he was in grade 10 and he is now in grade 12.
In her last words to she advised her husband to love and respect the woman he wants to marry and not mistreat her the way he did to her.
In his statement, Mbao told the court that all was well when he married his wife traditionally but problems started when his wife started drinking beer and clubbing in night clubs such as Masaka and Chez Ntemba.
“She used to be with a friend I did not approve of but she could not listen to me. When I talk to her, she would brag saying that she can go back to her father because he is a rich man,” he said.
Mbao said despite his father-in-law having so much hatred for him, he loves his mother-in-law whom he said has been there for him the time he was having marital problems with his wife.
He said he still loves his wife and wants to reconcile with her so they can keep their children together.
In passing judgment, the court wondered what kind of love Mbao has for his wife when he has not made love with her for four years.
The court also found out that Mbao had bad language towards his wife and he was not faithful to her.
“How do you tell your wife that she is not a woman enough? You have been teaching her what you saw in other women not disgracing her,” the court said.
The court said the duo’s marriage ended a long time ago as they have been on separation for a long time.
The court granted them divorce and ordered Mbao to compensate his wife with KR8,000 payable in instalment of KR200. The couple was also advised to share property acquired together equally.
