‘He Could Not Have Defiled Girl, He’s Impotent’

A WOMAN of Racecourse in Kitwe has told a court that her 61-year-old husband could not have defiled a 13-year-old girl as police have alleged because he is sexually inactive.
This is in a case in which Jordan Chikosa, a carpenter, is charged with defilement and has been found with a case to answer.
The offence is contrary to Section 138 (1) of the Penal Code, Chapter 87 of the Laws of Zambia as amended by Acts number 15 of 2005 and two of 2011.
Particulars of the offence are that Chikosa, on May 4, 2013, in Kitwe, had unlawful carnal knowledge of a girl under the age of 16.
Testifying in defence of her husband on Monday, Matilda Chalwe told Kitwe senior resident magistrate Daniel Musonda that she was surprised when she learnt that her husband had been accused of defilement.
“We do not ‘meet’ as man and wife because he has a problem. He can’t perform as a husband,” Ms Chalwe said.
She said on the material day, she had gone for a church meeting when Chikosa is alleged to have defiled the girl.
In cross-examination, Ms Chalwe maintained that Chikosa does not perform sexually and that he is on medication.
And Chikosa’s 12-year-old son testified that he and his father were watching football on television in their house when the girl who
is alleged to have been defiled came to ask for 50 ngwee.
He testified that within a short time, some residents started throwing stones at the house and beat up his father.
In cross-examination, the boy confirmed that the girl and Chikosa met on the material date.
He also confirmed that the girl entered their house.
Chikosa’s defence continues.

    when did he become impotent?
    His 12 year son, is it by adoption?

      You can be impotent even after you have kids, it can come at any time in one’s life. Its just biology. Besides 61yrs – 12yrs = 49yrs he had the son around 49years thats the right time a man start having E.D (Erectile Dysfunction) aka Impotence… and Thats Just My Opinion! Pen Off.

    it is possible to have a son and stop functioning that means the man developed the problem after the boy was born 12yrs is a long time a lot could have happed. or he developed the problem when the wife was pregnant

    Am seeing a lot of ignorance in the comments. Impotence is not a mysterious thing, it can happen anytime in one life. It’s something that just develops, it’s just like any other dieses.

    Indeed I have as well observed a lot of ignorance on impotence. We really need to sensitise the people on this subject. This man can easily be taken for a test. We do not need to crucify him right now.
