Serenje Pupil Gets 5 years for Damaging Property

SERENJE resident magistrate Fidelisty Ngosa has sentenced a Grade 11 pupil of Justine Mukando Secondary School to five years imprisonment with hard labour for breaking 114 windowpanes valued at K7,000.
This is in a matter in which Oscar Simbeye, 21 was charged with one count of malicious damage to property contrary to the laws of Zambia.
Facts before the court where that on July 1, 2013 around 21:00 hours, the school’s head teacher, Teddy Simwanza, heard pupils chanting, ‘we want water!’ and when he went to address them, the pupils turned violent and started breaking the panes.
The court further heard that Simwanza ran for his life and reported the matter to Serenje police.
And the prosecution noted that officers rushed to the school and upon seeing them, the pupils scampered into the bush. This prompted the officers to carry out investigations which led to the apprehension of Simbeya who was believed to be the ringleader.
And assessments carried out at the school by the officers from Buildings Department valued the damaged windowpanes at K7,000.
In mitigation, Simbeya pleaded with the court to exercise leniency on him as he was a school-going child.
And magistrate Ngosa said the court was aware that Simbeye was the first offender and deserved leniency, but said he should have thought twice before damaging the glass panes.
“I am sending you to jail for five years with effect from 29 July 2013. The sentence is subject to confirmation by the High Court,” magistrate Ngosa said.

    good job,at 21 he deserves to be in jail and not in grade 11. this will send strong signals to the half baked unza stone throwers graduates association of kalingalinga .lol

    its a good lesson to the others but they shud have arested all the grade 11′s at that school.

    not fair at all….this is too much….. 6 months simple imprisonment is more like it for all grade 11 pupils

      It is 5 years with hard labour. The six months simple imprisonment is for the tax driver. You are mixing the two cases up.

      Love it’s fair infact he was suppose to complete grade 12 at 18 he was there just to confuse youngsters let him to serve 5 years he is a junk

    I agree with you my love, moreover, he was not acting alone. His age does not change the fact that he is still grade 11. Those five years will destroy his future permanently. I am not saying he should not be punished, the punished is just too much considering that he was not acting alone.

      Sad state of affairs.he is only 21 his whole life will be destroyed by this surely someone must step in and ask that his sentence be reduced.Make him do community service or something

    Very unfair. People who store hundreds of bicycles and burried cash are still beathing fresh air. Please give him 5years community service repairing all glass panes in Zambia schools.

    IS THIS JUDGE A HUMAN BEING OR WHAT,HOW DO YOU SEND MWANA WAMUNZAKO 5YEARS WAS HE ACTING ALONE.THIS JUDGE WONT LEAVE LONGER ON THIS EARTH

    According to the facts above, it’s not proved beyond doubt the boy broke the window panes. Merely being a ring leader does not mean he physically broke 114 windowpanes.

    The parents to the boy must appeal to the higher court. No witness proved seeing the boy in action.

    Lookin @ de case he invlved in,nd been a ring-leader the police state was supposed to pick him up and ask him to direct them to other houses of culprits!

    So that atleast 30 of them jailed and each gets 1year sentence.

    Like that it culd be a fair judgement to all.

    Next time ba judge do as wise!

    his sentence should be reduced to a manageable one say 6 months. however he may find it difficult to get a school place in any other school after being identified as ring leader.all pupils and students should learn from this set precidence.

    How do you sentence a minor like that.The sentence is too harsh!
