Judge Stops, Fails to Deliver Judgement In Liato’s K2.1Billion Case “His Nephew Has Sexual Affair With Liato’s Daughter”

The case in which Austin Liato is charged with concealing K2.1 billion suspected of being proceeds of crime took a twist when the judge hearing the case decided to recuse himself (stop hearing the case).
High Court Judge Dominic Sichinga was supposed to pass judgment but instead told the court that he couldn’t because one of his nephews has a sexual affair with Liato’s daughter.
Liato, a former minister in the Rupiah Banda administration was found guilty by a magistrate court of concealing K2.1 billion now KR2.1 million suspected to be proceeds of crime.
Liato appealed to the High court arguing that the money was his, legitimately acquired and that the prosecutors failed to prove that the monies were proceeds of crime.
It was this matter that Judge Sichinga was supposed to settle but instead he said:
“I wish to inform this court that I am with immediate effect recusing myself from handling this matter because from the day I sat to hear this matter last week on Friday; it has come to my attention that one of my nephews is courting the accused’s (Liato) daughter.
‘I therefore, feel professionally and morally that I recuse myself from hearing this matter and passing judgment. Justice must not be done but must be seen to be done and that is justice. I will with immediate effect surrender the case file to the judge in charge and will advise on the conduct of the case,” Judge Sichinga said.

The idiotic Judge is OK. He may have failed return the money to the Liatos if he pronounced him guilty or he would have been roasted by the entire Zambia if he pronounced Liato as being ‘NOCHI Guichy’ (Not Guilty)

That is how the judiciary should function.Transparency and following laid down procedures is a key aspect of these institutions.The judge calls the parties concerned and openly addresses his conflicting interests.The he recuses himself from the case.
Not where you go to court and to your astonishment you find that Judge Nigel Mutuna has taken over the case.Re-assigned by Judge-in-Charge Kajimanga and approved by Justice P Musonda.He then informs you that Judge Albert Wood recused himself and even fails to explain why.Instead he gets annoyed.
I hope people can now understand why the tribunal is necessary.

Sichinga was using nephew to extract bribes from the Liato family, using Liato’s daughter. Now they have known each other so much that the end result is now sex before marriage. What a shame to our judiciary? Was better if he cited another reason than to discredit himself inspite of his underhand acts thru his nephew. Investigate his nephew, u will be shocked to c what he owns. I rest my case!

In Zambia everyone is related to everyone, so there is no excuse for him to fail to pass judgement. Next time we will be hearing is that the police officer could not arrest someone because they are related, they have to pass responsibility to another one. If you have failed to pass judgement just give him the money back and close the case. If it was a poor guy who had stolen a chicken this time he would have been languishing serving 10 years sentence.

Ba sichinga u r a let down. Why bring unnecessary issues in the case. Liato surely knows u r the judge in charge and therefore he sends his daughter to flirt with your nephew (not son or brother) so as to fool u into recusing yoself. All because of money. Nephew temwana obe so teti utwebe ati ni ishu yakosa to not make a decision. Taubomba mwino!
