Lack Of Sex Makes Lusaka Man Desert Home

By MUNIDE ZULU
AS A way of punishing his wife for denying him his conjugal rights, a Lusaka man deserted home and stopped paying rentals for her.
Phillip Musonda, 38, of Mtendere township opted for this severe punishment to make his wife change her irrational behaviour of denying him sex.
He, however, got a shock of his life when what he thought was a punishment enough to change his wife’s attitude of refusing to have sex with him turned sour after she sued for divorce.
“We cannot divorce because we have been together for 14 years. I love my wife and we have a child together. I also want her to enjoy my gratuity,” Musonda told Chelstone Local Court magistrate Bertha Zulu, who was sitting with senior presiding magistrate Hope Mwila and Lewis Mumba.
Upon hearing her husband’s refusal to divorce her, Sophia Kosamu produced a picture of a woman and asked him to explain his relationship with the photographed woman.
Musonda sheepishly said: “She is my girlfriend. I knew her when we were on four months separation.”
In her statement earlier, Kosamu, who got married to Musonda in 2007, said her husband has been irresponsible since the time he deserted her as he has not been paying rentals and providing for her needs.
She also complained that her husband has never driven her in the car, which he bought despite being his wife but has done so to his lover.
“I refused to be driven in that car because he first drove his lover before giving me a ride as his wife,” Cosam said.
Magistrate Zulu, however, dismissed the claim, saying the duo was just co-habiting as no dowry was paid.
“It was just a boyfriend and girlfriend relationship. The court is, however, ordering you Musonda to pay your now former lover 30 percent of your gratuity for wasting her precious time,”
The court also ordered him to be paying child maintenance fee of K300 and Kosamu was given custody of their only child.

why is that even when it is not the fault of the man, the justices will always ask the man to compensate the woman. In the given senario, Magistrate Zulu, dismissed the claim, saying the duo was just co-habiting as no dowry was paid.
“It was just a boyfriend and girlfriend relationship. The court, however, ordereded Musonda to pay his former lover 30 percent of your gratuity for wasting her precious time,” What time when she knew very well that they are not wife and husband. What will happen now is all our girlfriends will now line up to share our pension all in the name of wasting time.
    justice denied

If they got married in 2007, then they have been cohabiting for 6 years NOT 14 years as in this story.
