Mpongwe Farmer Jailed For Sexual Assault
NDOLA High Court judge Petronella Ngulube has sentenced a peasant farmer of Mpongwe to 15 years imprisonment with hard labour for indecently assaulting a woman.
When the matter came up for sentencing on Wednesday, Mrs Justice Ngulube upheld the conviction of Joseph Chikumbi, 23, of Samaluka farm and imposed a 15-year jail sentence on him.
Chikumbi pleaded guilty to indecent assault in the Mpongwe Magistrate’s Court and was committed to the High Court for sentencing.
“Much as I would like to exercise some leniency, this offence has a minimum sentence which I have to comply with,” Mrs Justice Ngulube said.
The offence is contrary to Section 137(1) of the Penal Code Chapter 87 of the Laws of Zambia, as read with Act number 15 of 2005.
Particulars of the offence were that were that Chikumbi,on January 24, 2013 in Mpongwe, unlawfully and indecently assaulted Agness Muzizi.
Passing the sentence, Mrs Justice Ngulube said she had taken Chikumbi’s mitigation into consideration but that the offence he had committed is serious.
“I have considered the record from the subordinate court and I am satisfied that the conviction was in order,” Mrs Justice Ngulube said.
In mitigation, Chikumbi said he was a first offender and was remorseful for his actions.
Facts before the court were that on the material day, Ms Muzizi was sent by her older sister to collect sweet potatoes from Chikumbi.
The court heard that when Ms Muzizi arrived at Chikumbi’s house, he took her in to a nearby bush, attempted to have sex with her and in the process tore her underwear.
Ms Muzizi overpowered Chikumbi and told her sister and brother about the incident.
They reported the matter to the police.
“At the police station, she was given a medical report and examined at Mpongwe mission hospital,” the facts read in part.
Chikumbi was arrested and charged. He gave a free and voluntary statement admitting the offence under warn-andcaution.
The torn underwear and the medical report were submitted in court as evidence.
