Ndola Man ,26, Admits Having Sex With Girl, 14
A 26-YEAR-OLD general worker of Chipulukusu township in Ndola has told the Ndola Magistrate’s Court that he had carnal knowledge of a 14-year-old girl on two occasions because he was in a relationship with her.
This is a case in which Emmanuel Mumba of house number B22, Chipulukusu in Ndola, is charged with defilement.
The offence is contrary to Section 138(1) of the Penal Code Chapter 87 of the Laws of Zambia as read with Act number 15 of 2005.
Mumba told chief resident magistrate Paul Chisha on Tuesday that he had sex with the girl because she looks like an adult and he did not know her exact age.
“Your honour, I admit the charge. I had sex with her because she is my girlfriend and I thought that she was 16 years [old] because she appears like it,” Mumba said.
Particulars of the offence are that Mumba on October 18, 2013 in Ndola, had unlawful carnal knowledge of a girl under the age of 16.
Mumba also told the court that he had sex with the girl because he thought that she was an adult who is “fit” for sex.
Mr Chisha adjourned the case to November 7, 2013 for commencement of trial and remanded Mumba.

gents, defilement is having sex with a minor (a girl who is less than 16 yrs old). it has not been clearly explained if its a boy who gets defiled. some girls start prostitution at the age of 14 yrs and they look as if they are 17 or older. also parents, how do you leave a minor to do things on their own without any guidance? a 14 yr old is supposed to be in grade 7 or 8.how do u gather the courage to even talk to these girls imwe guys.if shes asking for money just assist if u can.

It is very embarassing to see what people are able to say on this blog. Lets first think about a child a small child for that matter who unfortunately you have no love and concern for. Surely God will punish you all how are corupted in mind and say as long as the shoe fits. This is very interesting case.It is also a learning point 4 the courts of law.
1.The girl had sex with the man twice but only reported the second time
2.If the girl accepts a relationship with a man,she expected the man 2 demand 4 sex.
3.The court must spell out how men will know the age of these girls on the streets.Otherwise,the girl knows her age and agrees 2 sex,then why punish the man.

@Pichu, defilement is having carnal knowledge of the girl below the age of 16. However, it is not defilement to have carnal knowledge of the girl below the age of 16 if one is legally married to her. Be also advised that a boy can not be defiled since in defilement penetration into womanwood has to be proven and a boy does not have the canal which can be penetrated into.

Money from Girls side was not enough hence to report the matter as defilement.How can the matter be reported now when they had for the second time?The young man has spoken the truth that he had sex for the second time because that was his girl friend.Due to certain poverty levels in our Community young girls are used as tools for survival in this harsh environments in our day to day lives with intent.
