KITWE High Court judge Catherine Makungu has thrown out an application by Word of Faith Soul Winning Ministries Bishop Maxwell Musonda for an order to expel three members of his church for allegedly attempting to oust him.
This is in a case where Bishop Musonda sued Esson Simbeye, Edwin Bwalya and a Pastor Kalulu as first, second and third defendants respectively.
Bishop Musonda was claiming damages for nuisance and an order declaring that the three defendants were duly expelled from the church.
According to a statement of claim filed in the Kitwe High Court, Bishop Musonda also wanted the court to restrain the defendants, their agents and servants from repeating or continuing the said nuisance.
Bishop Musonda also complained that the defendants had embarked on a campaign to oust him.
But delivering judgement on Friday, Mrs Justice Makungu dismissed Bishop Musonda’s case with costs.
“I find no merit in the plaintiff’s case and I hereby dismiss it with costs which should be taxed in default of agreement,” Mrs Justice Makungu said.
She ordered that all parties concerned are now free to continue running the ministry and church in accordance with the Holy Bible, the Constitution and guidelines that may be given by the Registrar of Societies.
“I find that the defendants did not actually oust the second plaintiff (Bishop Musonda) from the ministry. The Registrar of Societies under the circumstances also had the right to intervene,” Mrs Justice Makungu said.
She also said although Bishop Musonda is now the only trustee in Word of Faith Soul Winning Ministries, he cannot be considered to be the owner.
Mrs Justice Makungu also declared that Bishop Musonda’s action to expel the three defendants from the ministry is null and void.
“The second plaintiff (Bishop Musonda) is egocentric and that is not a good trait befitting a man of God,” Mrs Justice Makungu said.

When we start hearing these things happening we should get concerned as a people of God.
Zambia has been declared a Christian Nation.
Those interested in statistics and history will remind me that not long ago, the percentage of Christian faithfuls in Zambia was well above 80%. But if one may want to check the same statistics today, figures are showing that the percentage of Christian Faithfulls is at a staggering 50%, with Hindus and Mohamedians sharing a 49%. 1% is traditional beliefs.
You will also remember that Zambia is a Nation where more than 50% citizens are unemployed, with atleast 86% of the population living on less than 2 meals per day. Plus fighting in the body of Christ.
This is a disaster and calls for serious reflection on our police makers.
People are suffering out there, and have been turned into slaves by their ‘masters’ in their own country.
People are joing these ‘other religions’ to benefit from them.

Bishop Musonda wants to remain eating alone in church………These Zambians pastors and their greed. Me I have changed my strategies with these atrocities in church, I used to give a lot and would think I am helping to spread the gospel of Jesus. When I came to realise that I was fattening pastors pockets I stopped and I do more of community work now like helping orphans and the elderly in society. I am more at peace with myself now
