Lusaka Husbands Girl-friend Drags Woman To Court For Insulting Her

A Visibly annoyed 25-year-old woman of Garden begged the Lusaka Boma Court to dismiss a case in which her husband’s girlfriend has dragged her to court for compensation for insults.
Barbara Chisanga told senior court magistrate Morgan Kayanika that she has never known peace in her marriage since her husband Richman Chisanga started dating Memory Nyirenda, 22, of the same township.
This was in a case in which Barbara was sued by Memory for compensation for insults.
But Memory, a bar lady in Garden, denied ever being in a love relationship with Richman describing him as a mere customer who frequents her bar.
Barbara told the court that life has been a struggle since Richman started dating Memory as he has completely neglected his responsibilities as a father and husband.
“For a long time I did not know the reason why my husband completely stopped providing for the family until I started hearing rumours about his affair with Memory. When I confronted him about it, he refused and said he only went there to drink beer, so we agreed that he stops going there,” she said.
However, she said last month on November 10, she saw her husband’s car parked at Memory’s bar. She said she followed him and they started quarrelling forcing Richman to drag her home to discuss the issue in the privacy of their home.
“I told him that I was leaving him because it was clear that he has failed to stay away from her even after he promised to do so. He insisted that there was nothing between them. It was only after he saw me packing my belongings that he confessed to being in a relationship with her but promised to break it off,” she said.
She said the next day she went to Memory’s house to beg her to stay away from her husband but Memory was uncompromising and instead adamantly told her that she would not leave him.
“I should be suing her for sleeping with my husband, not the other way round. They have both hurt me,” she said.
Her witness, Richman, confessed to being in a relationship with Memory but said their relationship had not been as strong as it was in 2011.
He said the last time he made love with Memory was in 2011.
He said they started dating in 2010 and that their affair has broken down.
Memory in her statement told the court that she did not know Barbara until she went to insult her and accused her of having a relationship with Richman on November 11.
“She called me all sorts of names in full view of my neighbours, who had gathered because of her shouting. She
claims I grab other women’s husbands. I told her politely that Richman was just a customer at the bar,” she said.
Her witness, Ruth Mhango, 14, told the court that Barbara went to Memory’s house and started insulting and calling her names.
Passing judgment, the court upheld the claim but the defendant was not fined citing an element of provocation by plaintiff. The court, however,cautioned Barbara against acting on impulse. She was also advised to sue Memory for adultery. The court also cautioned and castigated Memory and Richman for their conduct.

    These prostitues also they are causing problems in these homes. Especially because they really entertain the men such that men thibk they are sweeter than the wives. Wives do what you know best then yr husband will not go out!

    Good judgment, but it would have been better if Memory the prostitute was fined using the testimony of Barbra’s husband.

      Indeed fair Judgement, atleast such can be seen to be protecting the intergrity of the Judiciary.

    Wives’ reluctantance ‘n quarrelsome behaviour keep husbands away from home. You knock off from work expecing welcome home, insteady you find a moody, over confident and carefree receptionst in the name of “wife”. It’s just sad for love poshioned husbands that reeal hosts that comfort them when they are in need
