A FOUR-YEAR-OLD girl of Choma’s Kabubwe village narrated before the Choma Magistrate’s Court that a 39-year-old man allegedly undressed her and he exposed his manhood.
This is in a matter in which 39-year-old Sydney Mwiimbu, of Choma is charged with attempted defilement.
Particulars of the offence are that on January 9 this year, Mwiimbu, an unemployed resident of Mbabala area, attempted to have carnal knowledge of a girl under the age of 16.
Mwiimbu pleaded not guilty to the charge.
When the matter came up for trial before magistrate Victoria Chitulangoma on Wednesday, the four-year-old told the court that on January 9, Mwiimbu allegedly undressed her, laid her on the ground and removed his manhood.
“My grandmother arrived from the fields and found him while he was marrying [attempting to defile] me,” the girl said.
And testifying earlier, the victim’s grandmother told the court how she almost hit Mwiimbu with a stick after she allegedly caught him red-handed on top of her granddaughter.
The 40-year-old woman told the court that on the material day around 06:00 hours she went to her farm with Mwiimbu who helped her to carry some fertiliser.
“When we arrived at my farm, Mwiimbu left the fertiliser and asked me to escort him to a field he wanted to plough, which I did and came back to apply fertiliser in my farm,” the woman narrated.
She finished applying the fertiliser around 12:00 hours and returned home.
“Upon arrival, I found Mwiimbu in the kitchen. He was on top of my granddaughter. I was confused and looked for a stick so I could hit him but he fled to his home,” the woman said, causing laughter in the courtroom, much to the annoyance of the magistrate who ordered for silence saying, “defilement is not a laughing matter”.
She said the accused was apprehended and taken to Mbabala Police Station.
The witness said she took her granddaughter to the clinic where nurses confirmed that the girl was almost defiled.
Earlier, Choma district victim support co-ordinator Humphrey Chongo told the court that on January 10 he interviewed Mwiimbu in connection with the offense to which “he admitted but later denied committing the offence after being charged.”
In her ruling, Magistrate Chitulangoma said she was satisfied that the prosecution established a prima facie case against Mwiimbu.
“I find you with a case to answer and put you on your defence,” she said.
The matter continues on May 7, this year.
