Hotel Worker ‘Off the Hook’ After Threatening Superiors

THE Livingstone Magistrate’s Court has sentenced a Zambezi Sun Hotel linen room supervisor to one year imprisonment with hard labour for issuing murder threats against two senior managers.

Magistrate Adsen Shanduba, however, suspended the sentence imposed on Nephia Maluba, 30, for one year provided she does not commit a similar offence within the period.
This is in a case in which Maluba, of Dambwa North in Livingstone, was charged with two counts of written threats of murder, contrary to the Laws of Zambia.
In the first count, it is alleged that Maluba, on September 21, 2009 around 07:18 hours at Zambezi Sun Hotel in Livingstone, directly caused Guill Franco Togni to receive a text message which read: “We will burn you in your house, you can even die in your office while seated even today you can die careful.”
In the second count, particulars of the offence are that Maluba, on September 21, 2009 in Livingstone, directly caused Joanne Gorman Selby to receive a text message which read: “You will die in your office and when you are driving or you will see fire.”
Delivering judgment last Wednesday, Mr Shanduba said it is the duty of the court to apply the law in its totality.
“It is not right to be threatening people with text messages. You should know that there are people that have got hypertension, blood pressure (BP), so if you threaten them you might cause them to have a heart attack and you might be brought to court for another case.
“It is the duty of the court to ensure that the people that break the law are punished,” Mr Shanduba said.
He said Maluba committed an offence and she should be punished.
“If the courts don’t ensure that people like you are punished, they would be failing in their duties. You will go to jail for 12 months which will be suspended for 12 months, no similar offence should be committed.
“In the second count you will also pay K100 fine or in default nine months simple imprisonment, no credit you pay now,” Mr Shanduba said.
