Lawyer Sues Kavindele And Wife Over K67,000

11288KBF and Partners has sued Enoch Kavindele and his wife in the Lusaka High Court, demanding over K67,000 in unpaid legal fees.
According to a statement of claim filed in the principal registry, KBF and Partners, the plaintiffs in the matter, cited Kavindele as first defendant while Dorothy Kavindele is the second defendant.
The plaintiffs stated that on or about January 8, 2013, the firm was retained by the defendants to represent them in the case of Enoch Kavindele and Dorothy Kavindele Vs Bologna Properties Limited and Diego-2013/HP/0196, which the plaintiff accordingly did.
The plaintiffs stated that they rendered legal services to the defendants until October 25, 2013, when such services were withdrawn by filing a notice of withdrawal as advocates into court.
They added that they rendered a fee note to the defendant for the legal services rendered thus far on March 6, in the sum of K67,290, and the defendants acknowledged receipt.
The plaintiffs stated that they sent several reminders to the defendants over the outstanding bill, but to no avail, adding that the defendants have failed and neglected to pay the same and all efforts made to settle the matter out of court had proved futile.
They further stated that the defendants were truly indebted to the plaintiff and they had suffered loss and damage.
The plaintiffs are claiming the K67,290, any other relief the court may deem fit, interest at the current lending rate and costs.
In the matter in which KBF and Partners represented Kavindele and Dorothy, the couple lost the case which related to their Leopards Hill plot in Lusaka.
