Man to Serve 18 Months for Stealing Beddings

A MAN of Chipulukusu Township in Ndola has been sentenced to 18 months imprisonment with hard labour by the Ndola Magistrate’s Court for breaking into a house and stealing bed linen worth over K600.

Magistrate Ben Akende on Wednesday convicted Lewis Bwalya, 33, of house number B1 Chipulukusu after he pleaded guilty to housebreaking and theft.
“I find the accused guilty of the charge on his own admission of the facts as being correct. I note that the accused is a first offender who readily admitted the charge without wasting the court’s time, hence the rest of his mitigation shall be given weight.
“I sentence the accused to 18 months imprisonment with hard labour with effect from May 20 this year, the date you were arrested,” Mr Akende said.
He granted Bwalya leave to appeal to the High Court within 14 days
In mitigation, Bwalya asked the court to be lenient on him because he is a married man with five children.
Particulars of the offence are that Bwalya on April 2 this year in Ndola, broke into Emmanuel Musonda’s house and stole duvet, bed sheets and clothes worth K605.
Facts before the court read by public prosecutor Crispin Mukubanda are that Mr Musonda secured his house and went to Senior township market with his wife to buy some foodstuff.
The court heard that when Mr Musonda and his wife returned home, he found that someone had broken into his house and some property was missing.
Mr Musonda reported the matter to Chipulukusu Police Post and investigations were instituted leading to the arrest of Bwalya.
Bwalya admitted the charge when he was interrogated.

    This guy he knew he had 5 children, y did he steal. He is very useless and should have been imprisoned for ten yrs. The courts should not be so linient to criminals. If he had a chance, he would have kiled killed the owners to secure his freedom
