State Asks High Court To Find Keith With Case To Answer

The State has asked Lusaka High Judge Susan Wanjelani to find UPND Chilanga Member of Parliament Keith Mukata and his partner Charmaine Musonda with a case to answer for the murder of their security guard Namakau Kalilakwenda.

The State says the murder suspects should be placed on their defence because the prosecution has proved the element of the offence of murder.
The prosecution team led by Deputy Chief Advocate Mariam Bhar Matandala submitted that in the present case the controverted evidence was that the deceased died due to the gun shot by a gun which was loaded as testified by the Ballistic expert.

It was further submitted that the accused knew or ought to have known that by firing a loaded gun it would result in death or case grievous injury to
someone.

The State has also submitted that the fact that both were at the scene and in possession of a firearm which was established to be the murder weapon at the time in question shows an inference that the two acted in a common
purpose.

But in reply the defence have contended that it is their humble prayer that their submissions be sustained and upheld and that the accused be
acquitted because there is no record showing that Mukata’s firearm was the murder weapon.
