A commando has withdrawn a case in which he sued his ex-wife for assault after she brutally attacked him during a marital dispute. It is alleged that on October 2 this year, Vivian Bupe assaulted her ex-husband in self-defence after he beat her when he found her with another man. He reported her to police and was arrested and charged with assault occasioning bodily harm.
When the matter came up in court on Tuesday before magistrate Bubala Sikalunda, Mr Billy Nawa, 33, applied to have the matter withdrawn on grounds that his ex-wife had asked for forgiveness from him. He also said he was deeply sorry to his ex-wife and the court. “I wish to address the court that I want to withdraw the case of assault in which the mother of my children assaulted me. It was sad to learn that she appeared for plea. All in all, I have forgiven her,” he said.
He said his ex-wife has learnt a lesson from what happened and that he was worried that if she went to jail, his children would suffer. In response, Mr Nawa’s ex-wife (Vivian Bupe) thanked him for forgiving him and assured the court that she will never take the law in her own hands.
Meanwhile, the Ndola Magistrate’s Court has sent a man who allegedly murdered another man after allegedly stealing his blocks to Ndola Teaching Hospital to have his age determined. When the matter came up for mention before magistrate Changa Chitabo, Misheck Mapitau told the court that he was 18 and not 21 as indicated on the charge sheet.
This prompted magistrate Chitabo to direct the State to have Mapitau’s age determined by experts. “I order that the accused go for age determination before the explanation of the charge,” he said. In another case, two men of Ndola were on Tuesday discharged from court in a case they were charged with theft of 192 litres of diesel.
In this matter, David Nyanga, 23, and Victor Kalaba, 35, were on October 5 this year accused of stealing diesel valued at K2,812 from Zamtel.
The two were, however, re-arrested shortly after their discharge. They are expected to appear in court for fresh charges.
