The Supreme Court has refused to reverse a death sentence imposed on a man for stealing K1,000 cash and gaming coins from a gambling machine.
On November 24, 2015, Anania Tembo was found guilty of aggravated robbery and subsequently sentenced to death by the Lusaka High Court.
He appealed to the Supreme Court against his conviction, stating that the trial court misdirected itself when it sentenced him to death.

Facts before court are that while in the company of unknown persons, Tembo broke into Gilbert Siame’s gambling shop in Garden township in Lusaka where he stole K1,000 cash and gaming coins of undisclosed value.  He then attacked Joseph Litaba, who was guarding the shop.
The court heard that Tembo and his accomplice further blind-folded Litaba and threatened to shoot and kill him if he screamed for help.
Tembo was carrying a bag which contained a gun.

But when the matter came up before Supreme Court Justice Jones Chinyama, he rejected the appeal because it lacked merit. He said the conviction and sentence was properly done before the lower court. “On the basis of the foregoing evidence, we do not doubt that Tembo was properly convicted and sentenced to death. We find no merit in the appeal and we dismiss it,” Justice Chinyama said.
