STATE FAILS TO PROVE THEIR CASE AGAINST MAN ACCUSED OF IMPREGNATING DAUGHTER

Hastings Siambulo, a 41 year old man of Choma’s Maleba settlement accused of impregnating his biological daughter has walked to freedom after the state failed to prove their case against him.

Byta FM Court Beat Journalist reports that Siambulo appeared for judgment Thursday morning before Resident Magistrate Ethel Phiri in a case his wife and biological daughter were implicating him of incest contrary to the Laws of Zambia.

Earlier during trial, Siambulo denied impregnating his daughter saying he once caught her having sex in a room with another boy, an allegation the girl admits – but argues that she was already pregnant for her father then.

Siambulo, however, accuses his wife of trying to incriminate him out of fear that he would sue her for adultery after she got married to another man while they were on separation.

Magistrate Phiri has since established that the medical report shows the girl was pregnant, but fails to link the father to the pregnancy in the absence of a DNA test to establish the biological father of the baby.

She finds that the State brought to stand four witnesses with three giving evidence based on hearsay from the victim.

Phiri has since acquitted Siambulo while expressing surprise why the case was suddenly reported to police when the girl was pregnant, but not when the father was sleeping with her.
