Owner of Spax Mining and leader of the Jerabos Kabaso Mulenga who is facing murder allegations has sued the Attorney General and the Zambia Police over alleged unlawful detention.
Mulenga Alias Spax has further applied for leave that a writ of habeas Corpus be issued after being detained for over 15 days without any charge.
In a statement of claim filed before the Lusaka High Court, Spax says police arrested him on February 26 on suspicion that he killed a person identified as Emmanuel Mapunda Chibwe but no charges have been adduced.
Following the alleged failure by the police to formally charge him with an offense of murder, Spax now wants to be released as keeping him with no charges infringes his constitutional rights.
