Lusaka Man Assaults Wife For Reminding Him To Have Sex
A LUSAKA Boma Local Court has heard how a 28-year-old housewife of Mandevu Compound was severely beaten up by her 54-year-old husband after she reminded him to have sex with her.
Joan Mulenga complained before Senior Court Magistrate (SCM) Mable Mwaba that her husband Mumba Sakala had been giving lame reasons for not having sex with her and when she reminded him, he clobbered her.
“When our last born child was just born, I understood when he excused himself from performing his bedroom duties,” Mulenga said, “But I was shocked that days started turning into months but the excuse for not having sex with me remained the same lame one. He was claiming we couldn’t conjugate because the baby who used to sleep in the same bed as ours would disturb us.”
She added: “So, when I reminded him one night to have sex with me, he severely beat me up. I only regained consciousness at the hospital. He was later arrested but I withdrew the assault case when it went to court.”
Mulenga revealed this in a case in which she sued Sakala for divorce. Lusaka Boma Local Court records obtained by The Supreme Times indicate that the couple got married in 2003 and have 3 children between them.
Mulenga also accused Sakala of engaging into extramarital affairs. “He has a girlfriend. That’s the only explanation there is for a man who does not sleep with his wife,” noted Mulenga.
Mulenga further told the court that she had resolved to divorce Sakala because they have failed to reach a concession on the sex issue. She said even a temporarily separation failed to solve their marital differences.
But Sakala who objected to the divorce application refuted revelations that he was in the habit of denying Mulenga her conjugal rights.
“It is not true that I don’t ‘see’ her in the bedroom. We’ve always been having sex. Even right now as we are on separation, we still have sex. Just last week, she came home and we had sex. So, I am shocked to hear say I don’t perform,” said Sakala who due to his advanced age appeared as though he was Mulenga’s father.
Sakala added that due “to the so many” sexual encounters he gets to have with Mulenga, she recently fell pregnant but had the pregnancy terminated.
Sakala attributed most of their marital problems to insecurity on Mulenga’s part saying she insults any woman she sees him talking to.
But during cross examination, the couple engaged into a heated argument over the sex issue. Mulenga insisted that it was not true that they had been having sex.
“Just say the truth…Don’t lie. Do you think I could have brought you here if it’s true that you perform your duties in the bedroom? When did we have sex? Did I ever get pregnant for you recently? Just admit that you don’t do anything in bed,” Mulenga challenged her husband.
But Sakala insisted that he does have sex with Mulenga saying if she was willing, he could have sex with her just there in court.
When asked by the court if she would get back with Sakala if he ‘changed’, Mulenga vehemently refused saying he had troubled her a lot. Even after several attempts by the court to reconcile the couple, Mulenga still refused.
Thus SCM Mwaba dissolved the marriage and in reference to Mulenga said, “although I have powers to force a donkey to go the river, I can never force it to drink the water.”
Mwaba appealed to men to marry only women they can manage to satisfy in bed.
“At 54, you were supposed to get a slightly older woman. This woman you got is fit to be your own daughter and she’s too energetic for you,” she said, “So, this should send a loud message to all of you men. Don’t go for what you can’t manage.”
She also added that although it was Mulenga who denied Sakala, she still deserved to be compensated. Mwaba thus ordered Sakala to pay Mulenga K9 million as compensation. She also ordered that Sakala starts paying a monthly allocation of K250, 000 for child maintenance.

The only problem i see here is that the local courts use some different laws i do not understand. Why is that even when it is not the fault of the man, compensation is always given to the woman? In this case how much did the man pay as ‘lobola’ and compare with the compensation figure? Do you tell me he paid more than K9m? In my village if a woman decides to leave a man for whatever reason, the man claims the ‘lobola’ back.
The people tasked to look at Judicial reforms must look into issues of the local courts because justice there has never been dispensed equitably.
