POST editor Fred M’membe says he is ready to meet Rupiah Banda in court and show how crooked and corrupt he is.
Responding to a letter from Banda’s lawyer Makebi Zulu in which the latter gave The Post five days to render an apology and retract the articles published as editorial comments on April 16 and 17, 2014 respectively stating that Banda abused his office while he was president of the Republic of Zambia, M’membe stated that the newspaper had never commented on matters that were in court and had no intention of doing so.
“We acknowledge receipt of your letter of April 22, 2014 in reference to the above captioned matter. We have never commented on matters that are in court and we have no intention of doing so. But on the other matters where we comment, we do so believing that your client is a crook and a corrupt man. And these are comments we have made from the time he was president,” M’membe said. “Please feel free to take action against us in any court if you feel that your client is defamed and is not a crook, thief and a corrupt man. We are ready to meet him in court and show how crooked and corrupt he is. As for an apology or retraction from us, you won’t get any.”
In his letter addressed to M’membe, Zulu stated that he would not hesitate to seek redress by instituting contempt proceedings in the High Court if M’membe did not retract his sentiments.
“In your editorial comments of 16th April 2014, you did write of and concerning our client by name that, inter alia; he abused his office while he was President of the Republic of Zambia. This was stated in the following words:’…Rupiah only became rich after becoming President when he started abusing his office to enrich himself’,” Zulu stated.
He stated that M’membe was aware that Banda was appearing in court on alleged charges of abuse of authority of office.
“You have contumeliously and in total disregard of the sub judice rule commented and made reference to our client suggesting that he is guilty of the charges levelled against him even before a court of competent jurisdiction makes a pronouncement,” Zulu said. “Our client’s presumption of innocence is constitutionally guaranteed unless and until a court of competent jurisdiction rules otherwise.”
He noted that M’membe was not a court, neither was he competent to draw conclusions in matters that were before court.
“Your editorial comment thus borders on contempt and should you not retract and render an apology, we will not hesitate to commence contempt proceedings against you,” Zulu said.
He further complained of the editorial comment entitled “Character” published on April 17 with the following words: ‘Look at Rupiah Banda – very sweet, charming personality, but look at his character! It is that of a crook.’
“This comment is in itself defamatory per se of our client. Whereas you have a platform (your newspaper) to express your contumelious opinions, our client has none,” he stated.
Zulu stated that if M’membe did not render an apology and retract the articles complained of within five days, he would swiftly move the courts for an appropriate remedy.

Tina I agree with you 100% that RB is far much better than Fred Mmembe himself. RB never preached acrimony, hatred or discontent among unsuspecting citizens before, during and after his reign. I am very certain that Fred’s end will be disastrous and humiliating, mark my words!

Membe is not the right person to call RB as corrupt. Membe is just a hypocrite who takes Zambians for granted. It is clear that the PF regime is one of the most corrupt in the history of Zambia but Membe has deliberately kept quite. Reason? Membe is feeding from the same plate with Sata. What can Membe say about the mismanagement at ZAWA? What can he say about his trucks which were impounded with stolen copper? What can he say about the tender irregularities at Ministry of Information when his associate (Malupenga) was PS? Sata is not the best leader. To the contrary, he is the worst. Membe is not supporting him for being the best. He is supporting him for financial gain. Infact, Sata and Membe have two things in common: both are dictators and like eating with both hands. The best Membe can do is to keep quite. It will be dangerous for him to throw stones when he knows that he is living in a glass house. This is the same chap who deceived many Zambians to vote for PF despite Sata’s questionable leadership qualities. Many Zambians are now regreting because life has become harder under PF. Membe cannot feel any economic hardship because he has gotten a lot of favours from Sata for turning his paper into a publicity wing for the PF.
