Chililabombwe Man, 26, Jailed 17 years for Indecent Assault

A 26-YEAR-OLD man of Chililabombwe has been sentenced to 17 years imprisonment with hard labour by the Kitwe High Court for indecently assaulting a 17-year-old girl.
High Court judge Judy Mulongoti on Wednesday upheld the conviction of Lazarus Nkhosi by the Chililabombwe Magistrate’s Court.
Passing the sentence, Mrs Justice Mulongoti said it is disheartening that sexual offences are on the increase and women are no longer safe.
“I have considered the mitigation by your counsel that you are a first offender and that you are remorseful. I sentence you to 17 years imprisonment with hard labour from the date of your arrest,” Mrs Justice Mulongoti said.
Particulars of the offence are that Nkhosi, on August 15, last year in Chililabombwe, indecently assaulted a girl.
During trial in the Subordinate Court, the girl testified that on the fateful night, she was walking home from W area in Chililabombwe, where she had gone to attend a funeral, when she met Nkhosi with his friends.
She testified that Nkhosi proposed love to her and when she turned down his advances, he beat her up and dragged her into a drainage.
Mrs Justice Mulongoti narrated Nkosi and his friends later took her to Chililabombwe playgrounds and undressed her.
The girl testified that one of Nkhosi’s friends tried to forcibly have sex with her and that Nkhosi also did the same.
She told the court that a passer-by reported the matter to the police and that when the police arrived at the scene, they found Nkhosi on top of her.
And Evelyn Kumwenda told the court that as she was walking home around 22:00 hours, she heard someone screaming for help.
Ms Kumwenda said she rushed to the police station and reported the matter and that within a few minutes, she and two police officers arrived at the scene and found Nkosi on top of the girl.
