Two Men Jailed For Stealing A Bicycle Worth K250

Two men of Livingstone have been sentenced to one year imprisonment each with hard labour by the Livingstone Magistrate’s Court for stealing a bicycle worth K250.
Magistrate Naomi Sithole, however, suspended the sentences imposed on Clement Mulemwa , 23, a general worker and William Mwakama, 18, for one year provided they do not commit a similar offence within that period.
Passing the sentence last Tuesday, Ms Sithole said she had considered Mulemwa and Mwakama’s mitigation but that they do not seem repentant despite spending two months in prison.
“I can fine you or send you both to prison for two years but I will exercise maximum leniency on you, I will send you to prison for 12 months, which will be suspended for 24 months on condition that in the period of the suspension, you do not commit the same crime,” Ms Sithole said.
In mitigation, Mwakama begged the court to forgive him because he was not aware that the bicycle was stolen and that he is unwell while Mulemwa said he is a first offender who deserves leniency.
Ms Sithole said the prosecution had proved its case against Mwakama and Mulemwa beyond reasonable doubt
Particulars of the offence are that Mwakama and Mulemwa on March 3 this year in Livingstone, jointly and whilst acting together stole a bicycle worth K250 from Lucas Mungole.
