In this story, Peter Sinkamba of the Zambian Greens says there is no way that the Constitutional Court can revist it’s decision on the 2016 UPND Presidential Petition, shattering hopes by party supporters that Hakainde Hichilema and Geoferey Bwalya Mwamba will be inaugurated as President and vice-president respectively.
Sinkamba had petitioned the Judicial Complaint Commission (JCC), demanding to know why the Constitutional Court judges should not be punished for flip flopping in their decision during the petition.
The JCC ruled that the Constitutional Court judges erred when they adjudicated that the Presidential Petition hearing in 10 and not 14 days.
But Sinkamba said the JCC ruling has no impact on the Presidential Petition and that the decision cannot be reversed.
But Mwamba, popularly known as GBM said the Presidential Petition is still active and it will be followed until it reaches logic conclusion.
GBM said it is only Hichilema and himself that can say that the Presidential Petition is over because they are the ones that sued President Edgar Lungu and Inonge Wina for electoral fraud.
This is contained in the Kwacha Celebrity Weekly Newspaper to hit the streets on 4th January 2018.
I can see a situation where UPND will be pursuing this petition beyond 2021.
