The Choma Local Court has ordered a father in-law to pay back marriage dowry (Lobola) because her daughter filed for divorce just after one month of marriage.
Byta FM Court Beat Journalist reports that Noah Siatyaka dragged Richard Moono, his father-in-law, to the Choma Local Court claiming a refund of two heads of cattle and Eight Hundred Kwacha – money paid as lobola.
Siatyaka told the court that he has only been married for a month and his wife ran away from their matrimonial home and went back to her former husband’s place.
Siatyaka further told the court that his wife told him that she does not love him as she was only forced to get married to him.
He added that he did not enjoy his marriage and as such, wanted a refund of his dowry.
Meanwhile, Richard Moono told the court that her daughter ran away from her husband’s home because he could not satisfy her in bed during the one month of marriage.
But the plaintiff argued that if he was not good in bed, he would not have had a child with another woman.
When the matter came for judgment before Magistrate Luyando Siachitema, the court noted that Siatyaka was legally married to Moono’s daughter who later left her matrimonial home because of her misbehaving.
The court added that the issue of poor bed performance is between people who are married and is not supposed to be known by in-laws.
Magistrate Siachitema then ordered Moono to refund the dowry by September 22nd, 2019 because the plaintiff did not enjoy his marriage.
