OVER 1,000 miners at China Non-Ferrous Corporation Africa (NFCA) Mining Plc in Chambishi and those from a contracted company JHCX Mining Construction Zambia Limited have been dismissed following the protests that have recently rocked the Chinese mining company.
This is according to separate memorandums dated October 19, 2011 signed by NFCA chief executive officer Wang Chunlai and his JCHX Mining Construction Zambia Limited counterpart Zhang Jun, made available to the Zambia Daily Mail yesterday.
The memorandum reads: “Following a memo issued yesterday [Tuesday October 18, 2011], asking you to report for work today the 19th October 2011 [yesterday] and [sic] you subsequently refused to observe. You are now all summarily dismissed with immediate effect. However you have a right to appeal within 48 hours. Your leave days accrued will be paid to you by the month-end of November 2011.”
NFC Africa Mining Plc Manager for Corporate Affairs Nelson Jilowa confirmed the dismissal of over 1,000 workers out of the 3,000 miners engaged at the Chinese mining giant.
“I can confirm that there is a memo and over 1,000 out of a total of 3,000 workers are affected,” Mr Jilowa said.

Mr. RB brought all these evil ways in our country. He very much embrassed the his fellow chinese as if they were eggs to break when they fall down. He had a very big share in their mines that’s why they are so used to do anything to our loving people who are sweating for nothing but peanuts. Remember the scandal in Southern Province, people were shot at but nothing happened to the chinese bcoz they knew Banda Bwezani Kumunzi would be their for them. Now, there it is again, people complain of their salaries being low, they are dismissed. Where are we Zambians going to run to for our plea? Please…..Ba Tata ba Sata, may you enter each organisation in Zambia and see how your people are suffering. This is similar to some Councils in Zambia e.g Sinazongwe District Council being the third in Southern province to have more resources to enable it pay better salaries to their worker and this where the lowest paid is getting a K600,000.00 per month, a Secretary getting K1,000,000.00 is this good I wonder? Chinese investors have no problems. The problem is our labour laws. For example our minimum wage is at about K430, 000 so what do you expect an investor to pay its workers? Some are even boasting that they are paying better than the mininmum wage, say K600, 000. The govt should quickly look into this problem.

The Constitution of Zambia entrenches the principles of natural justice, specifically the right to be heard. It can now be viewed as a labour law custom or norm in that country and could consequently take effect, even where legal provisions under a collective agreement are not in place. The right to be heard would apply where an employee is being dismissed in relation to some charge of misconduct or wrongdoing and would also incorporate the opportunity to defend oneself. In Zambia, this is translated into the right to be informed of the specific charge and the ancillary right to the services of the trade union representative or a lawyer to defend such a charge (sec. 91, ILRA). Further, where the governmental labour authority gives effect to his or her investigatory powers in relation to dismissal matters, the rules of natural justice will be followed.
Before proceedings for dismissal may commence, an employee is entitled to three warnings about conduct considered to be wrongful, thus giving him or her the opportunity to reform.

How can you dismiss someome one without giving them a chance of to be heard which is an obrogation of the the The Employment Act Cap 268 section 26A of the Laws of Zambia.
Secondly our Zambian managers are highly to blame for this state of affairs because they have failed to interpret the laws so that the so call investors appreciate what our law demands.
Further more, it interest to have people work in zambia when they can speak englsh, they have to communicate through the interpretor, shame on us Zambian for allowing this non sense.
A complete overhaul of the labour system in zambia is required.
