JAMES BANDA Given 48Hrs To Appear In Court, Or Else?

EMBATTLED FORMER republican President Rupiah Banda’s son James must face court in less than 48 hours following a complaint from a Lusaka banker Noel Nkoma who reported him to police for assault, police spokesperson Elizabeth Kanjela has said.
“The matter of Mr James Banda is now in the hands of the courts,” Ms Kanjela said, “he must face the courts because we have nothing to do with him anymore and cannot comment any further…he must face court.”
According to court records obtained by The Daily Mail show that James known fondly by his friends and admirers by his moniker ‘JIMBO’ must appear before a Lusaka magistrate court no later than November 2. The consequences of failing to appear a second time maybe dire.
Earlier yesterday Sunday 10/30, reports mounted that JIMBO may not make it for court but this was later corrected by Kanjela who said all she knew is that JIMBO “must appear in court” since the police had concluded its investigations in the assault matter that occurred at Lusaka’s upmarket five star Taj Pamodzi Hotel where Jimbo allegedly beat up Mr. Nkoma. The reasons for the spat remain vague.
Jimbo’s lawyer Lubinda Linyama confirmed his client was required to appear in court and dispelled reports suggesting he was not going to show up for the second time Jimbo’s whereabouts are known by Mr Linyama.
Mr. Linyama said the reason his client did not appear in court last week is because the order requiring him to do so only came at 17:00hrs the day before he was scheduled to appear.
The former President’s embattled son was already out of the country when the order was served, Mr. Linyama said in a phone interview yesterday.
Mr. Linyama said his client travelled out of the country because it appeared the complainant Mr. Nkhoma could have dropped the assault charges against him under unexplained circumstances.
“After his (Jimbo) detention the police released Mr. Banda on a police bond on condition that he appears in court for mention on October 20 but the complainant Mr Nkoma withdrew the case on 18th October,” Mr. Linyama said.
On Thursday last week, Mr. Nkoma declined to comment when asked to by this newspaper and asked the reporter to refer to court records that state that he was assaulted by Jimbo. He didn’t give any further comment regarding whether an out court settlement had been reached nor did he discuss dropping the assault charges.
“My client has never been placed on any travel restrictions and it was clear that the matter was closed because the complainant had withdrawn the case,” he said.
November 2 is the day Jimbo is expected to appear in Lusaka’s magistrate court without fail—for mention—following the state’s decision to disregard a theory that Mr. Nkoma could have dropped the case.

    Rupiah’s sons behaves like his father[RB] they took this country on their filthy hands.To hell with them,let the law take its course and make sure that James recieves fair justice like any other culprit in this land.Law does not discriminate anyone regardless of who the person is.

    Jimbo was just framed. Though Im a bit surprised they used Noel to do the dirty work. He’s usually smart. Guess he’s broke or something.

    I dont support violence but Noel was equally wrong. Jimbo is also a person and I think Noel pushed him too much. In Jimbo’s shoes i would kick the Noel guy as well. Jimbo was having a meeting and he did not refuse to speak to Noel but merely asked him to give him a few more minutes as he wound up his meeting but Noel guys became insultative and provokative. For what??? I think Noel was used but I am wondering why as he used to be smarter than that…politics change pipo for real!

    In law, provocation is no defense. So Mr Banda will just have to face the law and answer. He can however raise the defense of entrapment, that he was trapped into committing the offense considering the circumstances. Or he can consider temporary insanity. Whatever the case, he is in soup.     The law must visit the Law Breakers regardless of the case and status. Only a mob survives such cases but individuals are perpetual victims of such a fate. Jimbo is ordered to appear before the court period!

    Violence is un-acceptable. Jimbo could have sued for harassment. According to the press stories, he had witnesses. Anywhere in the world, the one who throws the first punch is the guy who gets it. For me, this has nothing to do with his other alleged crimes. Those should be handled seperately.

    But from ma yard its 3months suspended sentence.
    This should change in our new Judiciary system pliz!Pipo are charged under the same offence,but judgement is totally different.Moreover,pipo from comboni give reasonable mitigation compared to ba mwana mayard.

    If RB was wrong in leading the nation, after all it was not his wish to be who he was. You are suppose to blame the other president Mwanawwwwwwwwwwwwwwws who appointed him.
