UNRULY Ndola SOLDIERS Under Serious INVESTIGATIONS

ABOUT seventeen soldiers from Kalewa barracks in Ndola are under investigations after allegedly damaging property and beating up police officers on duty at Kansenshi Police Station.

The soldiers allegedly invaded the police station on Tuesday night, in an attempt to rescue their colleague who was in police custody.

Police sources said the incident occurred around 22:00 hours, when a group of soldiers stormed the police station and damaged a motor vehicle. The sources said the soldiers wanted to free their colleague who was being held for contempt of court.

“They, however, did not manage because their colleague refused to be freed. The soldier refused to break out of the cell because he was aware of the consequences with regard to his contempt charges,” the sources said.

Copperbelt Commissioner of Police, Milner Muyambango, referred all queries on the incident to Inspector General of Police, Martin Malama. A Times team that rushed to Ndola Central Police Station witnessed the arrival of three police vehicles with some of the soldiers who were reportedly picked up yesterday after an identification parade.

And Dr Malama said in an interview that he was awaiting a written report on the incident and that the law would take its course. He said the police where working with the Zambia Army to investigate the incident and that a comprehensive statement would be issued.

Meanwhile, Mr. Muyambango said two youths were killed on the Ndola-Kabwe road after being run over by a motorist. He said the boys, both aged 16 years, were riding on a bicycle when the speeding driver knocked them down near Bwafwano area.

Mr. Muyambango also said police in Mufulira picked up a decomposed body of a taxi driver, 12 days after he went missing. He said the body was discovered by young boys playing along a railway line in the outskirts.

Mr. Muyambango said the body was discovered on Monday and postmortem was undertaken at the site because of its decomposed state.

He also said a miner was killed at Mopani Copper Mines (MCM) in Mufulira after he was hit by a front-end loader at 1,488 meter-level of the underground mine.

    This will die a natural death. Such acts are treated well in the barracks and not in those stinking Police stations. Well treated discipline will be instill on those disgruntled soldiers. Zambia is known for disciplined military men. They must have smoked mbanje….

    Indiscplined soldiers..arrest and jail them! Six months in jail, they would have lost their jobs.
    They can not be employed as security guards afterwards because they will have a criminal record.

    policemen are just ****** when it comes to issues dealing with the military even when an issue is straight forward.
    It is sad the guy’s matter is contempt and he did well to refuse to leave the cells.
    Police do’nt want to reason to military personel in normal cases;i believe they have an inferior complex these chaps.
    Sorry they had to be sorted out.

    i know soldiers as most desplined pipo.But y doing that. they deserve some coplo punishment.It good that their colleague whom they wanted to rescue out of police custody frefused to get out,becouse he knew the consqences and thats being descplin.

    The Police were harrassing a uniformed Soldier (Lieutenant) in public, thats why the other Soldiers reacted that way. They cant put a uniformed Soldier in Cells, the guy asked for time to go and change the uniform.

    Gentlemen and Ladies,
    be careful how you comment on matters of this nature. There is protocol on how to deal with a uniformed soldier. there is a system under which uniformed men operate it is not the place of a simple policeman to deal with uniformed personnel! what has become of our military wings and public? It wasnt grossly misplaced for the soldiers to react that way they are drilled to ‘save’ each other and any misdemeanour by uniformed personnel must be dealt with using the military establishment. To be precise these soldiers should be respected and if the police have a civil case against ANY soldier they should revert to the appropriate channels. If this is not curbed it will be a case of military against ba ‘buju’ That is why uniformed men’s cases are not dealt with using civil procedures. Can we ALL educate ourselves on these matters before we go to town commenting on issues which are way beyond our depth?

    People, its only in Zambia where a military personnel are not respected. this will start to bring misunderstanding among soldiers and the police and its sending the rite signal in this country. Each and every soldier or officer falls under someone. Police please, help us by following the rite proceedures. remember you are not dealling with civillians but military personnel who have fixed aboard. So lets unit and work in harmony as this has the potential or bring war among security wings. Imagine if other soldiers joins in and start beating up whoever is putting on i police uniform, are you going to manage to bring the situation under control. its not the ault of the soldiers that you are living in those conditions, please accept that point. i am very anoyed with this and i beg that let the police lean to respect soldiers. Big up to those soldiers, Plse The GOVT, don’t punish those soldiers. it was espirit decorp.

    @ Mutesa i agree with you, the police need to follow the procedure when arresting.we know that no one is allowed to touch their uniforms including the police too but them they were unprofersional when arresting the soldier.

    am very happy abt wat happnd. Those soldier were jst exercising wat they were taught, it called Espirit Decoup. There wel trained to kill and so its a warning to all the jokers in Police coz they wil jst exercise on u since in Zambia we’re taking peace for granted.

    The story here seems to be half baked I was about to start commenting but from some of the comments it seems the story is more than what was written. What really happened? Ba buju arrested a Lt. in uniform? and bundled him together with civilians? In other countries when a military personal has a court case he is arrested by military police and kept at a military cell. These are military rules which must be followed. These chaps can be court martialed and it will be determined whether their Espirit de corps was genuine enough to survive punishment.

    Officers are commanders. Ever heard of platoon commanders? U can neva bundle a uniformed officer in police cells. Procedures hav 2 be followed. These over-zealous rif ruff police chaps need 2 b taught a good lesson. Orders are meant 2 b obeyed in the military.

    @monica mutesa and zima ndola. There is no problem to put a security personnel in custody dressed in uniform who has commited offence. When the offence he/she has comited demands to detain him/her in custody so be it, the only thing done is to remove headress(cap), boot and badges of ranks before detaining him/her in custody. Supozi uniformed officer of Ndola has commited murder in Livingstone, would u go to Ndola to let him remove uniform? no, u detain him/her right there and then. Above all, on this issue we don’t know whether the contept of court is from Local court or magistrate court. Police do not issue contept of court in cas u din’t know. Do not always have ill feelings against police, after all u have all that freedom of wrting nocence coz yo rights are protected by police. U imagine if the police go strike for a week I don’t think u can enjoy yo writing on this site. Mind yo urterances.

    Soldiers are trained to defend the nation from foreign enemies and police are trained to defend citizens from local criminals armed or un armed.Fellow Zambians Contempt is criminal case that arises from the courts of law. Normally it comes to the police officers as a court order populary known as warrant of arrest. In this cases police officers were acting on court orders , simply excuting a warrant of arrest.just being obedient to lawful authority a very important institution in a democracy like ours. We are a constitutional democracy were every body is equal before the law and equal protection of the law. This is the resason why sometimes when criminals are confroted by angry mob they run to police officers so that their lives are protected but face charges for offences commited. They have the right to life even if they are criminals. In short soldiers are not above the law no matter what excuse. We are equal before the law. All political rigthts and civil rights are justiceable like in this case if the right to liberty was arbitrary taken away from that soldier who was put in cells he can seek civil litigation against the state and the arresting officer for wrongful detetion or malicious prosecution. Instead of soldiers detenting the image of our army by taking law in their on hands.

    If u av no confidence in the police, ignore them.If u av no confidence in the army, ignore them too.surely there’s need to apreciate the freedom,security and peace enjoyed in our beautiful motherland.its all bcoz of the security wings lets respect them and the law too. PUT AN END to inflamatory statements that wud bring hate,ridicule and anarchy in this country amongst the security wings. who the cap fit let them wear it. no one is above the law

    interesting situation.
    1 can a soldier be detained in a civilian cell because u have removed his shoes and more important his ranks ( reduced him to a private) which is also a rank.
    do police men have the power to remove the ranks(from a commissioned officer)commissioned by the president and the police man only passed out by inspector of police or minister of home affairs,
    was the section that come to rescue the commander in order especially that he was ill treated (mind you officers even when captured in war[front-line] still never tortured by enemies)
    why was not the warrant of arrest (contempt of court)given to the army who could have sent a signal the all Zambia to bring this erring officer?
    this case has implications were there no police by just military presence like Kaputa.INTERESTING CASE

    I’m sure those unruly soldiers were corruptly enlisted in the army. Most unruly soldiers in our barracks are related to high ranking army officers. HEMCS should set up a Commission of Inquiry to look at recruitment in the Army

    @Walasa Nafufti when you go to the USA or Britain you will find that some families have been in the Army from their grandparents and great grand parents generation. Is that because of corruption? I think we have enough commission of enquiry. The soldiers can be dealt with by the command. Next time you will have police officers harassing the Army regional commander and say its ok because they are mandated. You should ask those at the task force what procedure they were following in arresting even retired Gen Musengule. These things have laws. But Iam not surprised as many police officers do not understand procedure. Which fortunately in the army is cardinal.

    Fellow Zambian Contempt of Court is a criminal offence c/sec of the penal code.Soldiers have no powers of arrest under this act. The affected soldier was not wanted for offences against discipline under defence act by a millitery tribunal, but by civil court where any one can appear weather police officer, army officer, soldier, minister ps e.t.c regardles status in society provided one has committed a criminal offence. The only thing police officers can do is to inform there superiors. There is nothing like lifting of immunity except for former head of states otherwise there is no special law for them. If there is any pls furnish the police with same so that this does not repeat itself. what procedure are you talking about? The issue of uniform ask them if they do not detain each other in uniforms. the trueth of the matter is that they do. Even sock each other in mad water in the same uniforms. Tell each other to roll on the ground or frog jump in thier socked uniforms. To them human rights doesnot count!

    Whatever the case sodiers should not behave this way this is thugary & indispiline. Its vry common for sodiers to rescue & and beat police this way. The is no jail for sodiers in Zambia. Their are Gaurd room jst for the barracks. A comtept is ordered by the court . Should the police make a distiction even a minister can go to jail for comtept. This comtept was committed bcz of indicipiline but the refusal by this officer to break cell shows that he know he is not above the law. This is a civil criminal case not a millitary criminal case. Afterall the civil court are better that court martials the stadards are better. But they are no jails for sodiers. Guard rooms only exist for dicispline not for crimes.If a sodier steals or beat someone away frm wars civil courts are used. Are the police wrong one maybe sometimes not this time. I HOPE this kind of behaviour which threaten nation security would not repeat its self.sodiers should know that they should behaviour to avoid cells or jail bcz even police are arrested. And jailed.
