LUSAKA Businessman CONVICTED For STEALING K6,000

A Lusaka Business man of Chawama Compound has been slapped with a Six Months imprisonment in default and 30 days of community service by the Lusaka Magistrate Court for stealing money amounting to K6,000.
Standing before Senior Resident Magistrate Joshua Banda was Robert Siame charged with one count of theft contrary to section 272 of the penal code chapter 87 of the Laws of Zambia.
Facts before the court were that Siame did steal money amounting to K6,000 from a complainant Shella Moono Bwalya’s Shop in Chawama compound after purporting to have been buying rice from the same shop.
Siame admitted the charge and pleaded for leniency.
In passing the sentence, Magistrate Banda said Siame is an able bodied man with the capacity to work as opposed to engaging in stealing as a means for survival.
Magistrate Banda further cautioned Siame not to take advantage of hunger to justify his action and therefore slapped him with a 30 days community service sentence and six months imprisonment in default.

This is rubbish how can they jail a person who steal K6,000,then people stealing billions of kwachas and burying the money at their farm are still loitering the streets.

@ JK, Theft & corruption from the smallest to the highest level should be punished. The Court was right to jail him. Even the complainant did well to pursue. 6pin is money too. Liato also thought K2.1 bn was very small compared to the trillions in govt coffers. This attitude should be corrected before it grows.

‘him who is faithful in little, will also be faithful in much,,’. If not corrected next time he will pounce on large sums. It always starts small. Even TB Joshua started with small amounts and now he has gone to the extent of womanising!

Theft is theft no matter how small in law. It’s up to the judge to use his discretion in passing judgement n that’s what he has done in this case. He has given him community service and if he fails to do that for 30 days, then he will go to jail for 6months.

Othrs ati persecuted, fwebambi ati prosecuted.
6months ovr 6pin is unreasonable-ofcourse its th act of stealing that he is being punishd for bt stil mor, 6mnths + a months cmmunity service ninshi mwayasana.
Ba foosa a month jail sntnce + 1month cmmunity servce is mor reasonble.

A person who has stolen and proved is called a thief. Either K6,000 or k2.1 bn both stole and they have to be punished accordingly. It wld hav startd wt 6 pin 2moro 10, 30, 100pin. Now take for instance he becme a director at a big firm, he wil take th same mentality and steal big. The Vice shld b stopd 4rm d start. More so its just 30 days community work and if he fails then serve th 6 months sentence. God bless Zambia

@CBU Moma, I’m with you, really whose money did Liato steal? The guy might have made his money through his Government connections & for fear of the new Government he did not want to keep the money in the Bank. Charge him with corruption yes, not theft!

******!!!!!! Why are people so paranoid? Ati they shud jail him and yet thieves dat still bilions are walking freely. The kapokoz, liatos and the rest. Wats with this country and its judicial system????? In zed if u steal small money u get jailed, but if u still bilions, all is well. W@ logic is applied kanshi?

  24. Humphrey

    December 30, 2011 at 8:07 am

Whats wrong with our Judicial system? they behave like big bullies who take delight in pouncing on weaklings while they are failing to take on their size. Why is it that only the poor and weak are the one’s jailed not the rich? Our judicial system is a scam. Let them take on their size the Liato’s, Kapoko’s and others if they want to show us that they are working not poor people stealing K 6, 000.

    If K6000 = 6months + 30 days community
    Then
K2.1Bn= 18yrs imprisonment wit 6 years hard labour.

  29. 2012

    December 30, 2011 at 8:45 am

very interesting i must say. how much did the complainant spend on transport to get a court summon? money to pay for the summon which is not issued free by the way? money to go and appear for case hearings which may not have taken a day? or this just over six pin? so in my opinion this could have been someone trying to settle some scores. but anyway theft is theft and once convicted in court, a punishment of some form will be slapped on you. as for mr laito, i think time will catch up with him. Let me let u in on something. laws of any land are made by the rich, powerful and influential pipo of the same land. What am i saying, since they are also prone to commit crimes they have put closes that aid them in their escape should they mess up. (fines & bail).

Stealing is stealing it doesn’t matter how much you are thieving because those that have stolen billions started small small until they graduated to pocket big amounts.

Hmm what kind of fool steals K6000 only? This is the reality of poverty in Zambia, whilst RB and sons were stealing billions of taxpayers money. Anyway, I have real hope that ba sata will uplift Zambian ppl’s living standards to the point where they no longer need to steal a pittance of K6 pin

They fail to jail pieces of shit who defile children. They give them a slap on the wrist as a prison sentence then they jail someone 6 months over 6 pin. Flawed justice system! The **** have some sense and heart and correct some these flaws.

remember this country is now bieng ruled under the ten comandment so thuo shall not steel and this person must be the example to others, this is totally difference from liato’s case he just buried the money not steeling and he has no a comlainant but this guy has a complainant he need to be slaped.

FOLKS, ALL THEFT FROM THAT OF ONE NGWEE TO TRILLIONS OF KWACHA IS THEFT AND MUST BE PUNISHED. SA’S FORMER POLICE CHIEF (EQUIVALENT TO ZAMBIA’S I.G.) HAS BEEN JAILED FOR 15 YEARS FOR CORRUPTLY OBTAINING APPROXIMATELY R160,000(ABOUT ZMK110MILLION). NOW, GIVEN THE GOVT RESOURCES AT THIS MAN’S DISPOSAL, THIS MONEY IS NEGLEGIBLE BUT HE’S NOW IN BOARDING! IN ANY CASE THE GENERAL TREND IS THAT THE INSTANCE OF ONE BEING CAUGHT STEALING IS JUST A MANIFESTATION OF WHAT THEY’VE BEEN DOING FOR MUCH LONGER!!
