SATA Appoints Acting Chief JUSTICE

REPUBLICAN President Michael Sata has appointed Justice Dennis Chirwa as acting Chief Justice during the absence of Chief Justice Ernest Sakala.

Chief justice Ernest Sakala will be out of the country from 6 to 11 February 2012 and justice Chirwa is expected to act as chief justice from 7 to 10 February 2012

In a letter to justice Chirwa, President Sata indicated that his appointment is in line with the powers conferred upon him by Article 93 (3) of the Constitution.

The President has also appointed Justice Lombe Chibesakunda as acting deputy Chief Justice.

This is according to a press statement issued by special assistant to the president for press and public relations George Chellah.

    this man mr sata is a problem since he got into power he has not adressed any issue concerning where our our country is headed the only thing he does is witch hunting ,annoying apointments and disapointments and persecuting his political opponents.infact enerst sakala is supposed to be retired.SHAME ON U MR PRESIDENT.

    Alien; you are an alien to Zambia, the very people Sata is sorting out. The chaps who stole need to be sorted out; so stop crying my friend. Next time vote your president, and lets see if he will win. Truth hurts; Sata is even kind, if it was a limitary man, no trial, no jury, no judge, just execute all wankers that promoted economic sabotage of Zambia. If you are one of them, keep watching your shadow mune.

    Why wait this long ? Ernest sakala could have been fired the same day Commander in chief Sata took office .He is the most Useless Chief Justice has ever produced in many yrs. Retired Judge Sakala don’t come back.You are a dead wood you have no teeth to bite

    President Michael Sata. We are tired of these alarming rumours, can these be stopped in Jesus name. We pray for peace to prevail in Zambia and we pray for God’s proctection upon our leaders.     The President has shown the world that no matter what people may say when you are down , you should not do the same thing when you go on top.Justice Sakala had some differences with H.E.M.Sata thinking that he will never be the republican Head of State.
    People let now know and respect our President,He is the president for all, those who voted for him, those who did not vote for him and those who did not take part in the polls.The facet is that He is the president for Zambia and its ” One Zambia, One Nation”

    Well done Mr President for showing Love to people who hart you most.Christ said Love your enemies and do good to them.

    Let Him leave when he wants, also make peace with Mrs. Mwanawasa and let it be known to the nation.

    Thank God the alarming rumours about President Sata have been removed from Wikipedia. Lord Jesus we pray for protection upon our leaders, may you raise up intercessors who shall not give you rest but will continuosly pray for Zambia until righteousness, peace , wisdom and love prevails over our nation, our leaders both ruling and opposition and upon all Zambians. God bless our Great nation which is a beacon of hope in Africa.

    That is how you honorably fire a chief justice. Cool Mr Presido!! Mambilima should also go and the others big roots of corruption at ECZ. Corruption was brought by Chiluba and all his succesors followed suit except HE L Mwanawasa SC. Now it’s got to out if the system. HE MCS vowed to change the system long before he came into power. Now he is doubg just that, haters muzanyala, you got used to feeding on corruption this time you gotta work hard to put food in your mouth.

    The Chief Justice and Deputy Chief Justice are politely being told, this is the new team of judicial officers who should lead the Judiciary.

    The honourable thing for them is to just resign and pave way for others to take over. The are constitutional officers who can not be fired but they are being told, you excess to requirements, and when you are retired man on contract, you certainly go to preserve your integrity

    To respond to some bloggers, one needs to write several pages because it seems some write from a very ignorant point of view. The happenings in the judiciary have not just started. This problem has been there for sometime now. This is so because of gross political interfereance. And here, I wish to commend MCS for refusing respond to calls to relieve CJ Sakala of his duties. It is better to let Sakala’s contract given to him by RB lapse. Interferance in the Judiciary goes back to the early days of the UNIP govt. The judgment in the murder case involving UNIP activists in Ndola was not well received by UNIP then. Lord Skinner as Chief Justice stood by the judge and opted to resign than succumb to political pressure. Aggrieved parties in any judgment have recourse to appeal through the laid down precedures. When Kaunda’s son shot and killed Tabitha, there was so much pressure on Justice Clever Musumali (or as it Bruce Munyama?) such that he decided to insert this passage in the preamble of his judgment: ‘WE THE GALLANT MEMBERS OF THE BENCH…’. This was an indication that he was going to follow the Law. Kambarage was sentenced to hung by the neck till pronounced dead. On appeal, Aniel Silungwe was recalled from wherever he was to preside over this case. This move brought a dark cloud on the judiciary even before the appeal was heard. Kaunda’s son was acquitted! There was even talk about ZMK10,000 compensation. The Post exposed Chiluba’s corrupt relationship with the judiciary. Justice Ngulube, that gallant lawyer, resigned as a result. Even now, some judgments stink of corruption and nepotism. Chilekwa is serving a jail term for telling Supreme Court judges what he thought of them in their face! They locked up his lawyer as well. This was in a matter involving Masiye Motels. It is now said that mostly opinions on cases are expressed and not judgments written. Why does the Supreme Court sits a minimum of a panel of three judges? Is it not for each to write his findings on each case? Some judgements can even be split, but the majority carries the day. Atleast two will express the same view. This promotes law development since precedents are set not opinions were in the local court. Although it is evident that the juduciary needs cleansing, we need to tread carefully. What we may do now may haunt us later. No matter how much we disagree with some judgments, the least we can do is to appeal, although in this country even appeals are withdrawn before they are heard! Let’s also realise that some actions are procedural, they take time to take effect.

    @Zambian,u are spot on…I am bemba but i feel 4 u indeed because even learned people here behave worse than illiterates and just comment anyhow.please people lets have some dignity and be mindful bcoz we did not choose which tribe to be born in hence we have no control over such things.bottomline tho is we all have blood running in our veins and whatever ethnic group we belong to should infact be immaterial when it comes to some issues.
