Labour NUISANCE Continues As LUMWANA Workers Complain Of Unlawful Number Of Working Hours And Violation Of Human Rights

Dear Editor,

Allow me to express my concern towards the serious violations Lumwana Mining Company is committing. It is about time that we aired our concerns as they have taken us for a ride for too long. Below are the concerns

1. Working Hours. Currently at Lumwana we work for 10 hours and 30 minutes in a day (from 06:30hrs to 17:00hrs). As far as am concerned our Labour laws states that the maximum working hours per day is 8 and any beyond is considered as overtime. Here it is not the case, and sometimes we are made to work for more than the 10hours and 30minutes without any overtime pay.

2. The MD has instructed the security officers to search everyone to see that there are carrying lunch. I have attached the memo which was sent out to all employees regarding this issue. This is a serious bleach of Human Rights, what I eat, whether I eat at work during the lunch break is up to me.

On behalf of Concerned Lumwana Workers

Below is the memo issued by the MD warning Zambian workers obtained by Tumfweko

Guys,i do not want any more nasty comments about Nyangulu,he helped me get a job with one of the catering contractors on site as HR Manager. Am equally unqualified for this position like him and i make unpopular decisions like him that anger my fellow blacks. When ever i have a problem,he visits me and he was the only one who came to see me was i was detained in a cell for two days a few months ago because of my bad decisions.Leave us alone because we are enjoying and are in money you jealousy fools.i clearly tell these whites not to increase your pay because you do not manage your finances very well.Nyangulu was my fellow gay at some point but he left me alone.

I can’t see why you guys are complaining about the meal arrangements.
The genuine complaint is about the overtime issue. If really they are not paying you overtime then it is a serious issue.

yr complaints do not make a lot of sense.the lunch issue is ok lest u will suffer from hypoglyceamia which is embarassing.10.5 working hrs is the order for all mines in zed, thanx for eye opener.there is no lunch in other mining fames.if u r lucky, kampompo is all u get.salaries at lmc are the highest in the mining sector.snr staffs in some mines get 4m.2m z housing alw then 2m z take home. that z after the just ended adjustments.mind u 4m z much less than $1000.

Lumwana Mine workers are amongst the highest paid in the mining industry, it would be unfair to ask for more money when your colleagues in other mining firms barely receive half of what you are getting.

Management should consider an over time rate which is in accordance with what Barrick is paying. Another issue is for these Boers or’Enforcers’ to use the correct form of language when addreessing employees to avoid stand-offs.

Unions should be pro-active in educating their members on economics and running a mine. Lets all be sensible and reasonable.

I very much doubt the complaint on OT, the problem with most us Zambians is that we do not read and prefer to believe what we hear as the Gospel truth. I have simple questions for my brother, how many hours per week do you work? How many maximum hours allowed by law per week before someone becomes entitled to OT? 48 hours per week is the maximum, if you can schedule to work your 48hrs in three days and rest as off duty the remaining days of the week that is your choice or choose to work about 7hrs per day then work through from monday to sunday that is another choice and you still be within the confines of the law, in short only hours in excess of 48hrs per week are paid overtime. The lunch break is not part of working hours and that is applicable everywhere in the world so it is not true that you work 10 & 30mins per it is less 1hr and if my maths is correct it adds to 48hours from monday to friday and I’m sure you do not work over the weekend. In summary do not cheat the public to win sympathy and make no mistake I do not work for Lumwana but these facts can be checked at any labour office in the country.
