President Michael Sata has with immediate effect suspended Justices Philip Musonda, Charles Kajimanga and Nigel Mutuna.
The President has since appointed a tribunal which will be headed by Justice Lovemore Chipoka of the Malawi High Court to investigate the alleged misbehavior of the three Judges.
Other members of the tribunal include retired Zambian high court Judges Naboth Mwanza and Thomas Ndlhovu while Chipili Katunasa will serve as secretary for the tribunal.
President Sata says the tribunal is expected to present him with a report on the findings in the next 2 months but that the tribunal may recommend on how long the process would take.
The head of State noted that his office has received numerous complaints about Justices Philip Musonda who is a Supreme court Judge, Charles Kajimanga and Nigel Mutuna who are High court Judges, from the Law association of Zambia, Lawyers within the judiciary and members of the public.
President Sata noted that the terms of reference would be based on the allegations that the trio interfered with a case involving the Post newspapers, Development Bank of Zambia (DBZ and JNC holding limited and Mutembo Nchito.
And President Sata explained that he has decided to engage Justice Lovemore Chipoka of the Malawi high court to ensure that the tribunal proceedings are conducted in an impartial manner.
The President has indicated that the deputy minister in the office of the Vice President Edgar Lungu would be sent to Malawi to deliver a letter of appointment to Justice Chipoka. Qfm

The tribunal should start with the DBZ loan. Is it true Mmembe and Nchito brothers owe DBZ 14 billion kwacha? Secondly, the judges have been suspended on hear say without proof. Why appoint Malawian judge? wasting allowances.

Maybe it’s a problem that our legal system does not have a JUDICIAL SERVICES COMMISSION of which all senior lawyers in the country are members, and which should recommend to the president who among themselves are suitable for appointment to the position of Judge, and like wise who should be reprimanded for any wrong doing.

If you’re planning a trip to the dentist, it might not be the wisest decision to make your appointment with the person you just broke up with.
A Polish woman is facing three years in prison after she removed all of her ex-boyfriend’s teeth during dental surgery just days after their breakup.
“I tried to be professional and detach myself from my emotions,” Anna Mackowiak, 34, told the Austrian Times. “But when I saw him lying there I just thought, ‘What a bastard’ and decided to take all his teeth out.”
Marek Olszewski, 45, reportedly showed up at Mackowiak’s dental office complaining of toothache just days after he broke up with her. She then allegedly gave him a “heavy dose” of anesthetic, locked the door and began removing all of his teeth one at a time.
“I knew something was wrong because when I woke up I couldn’t feel any teeth and my jaw was strapped up with bandages,” Olszewski said.
“She told me my mouth was numb and I wouldn’t be able to feel anything for a while and that the bandage was there to protect the gums, but that I would need to see a specialist,” he said.
“I didn’t have any reason to doubt her, I mean I thought she was a professional.”
Adding to his trauma, Olszewski said his new girlfriend has already left him over his now toothless appearance.
“And I’m going to have to pay a fortune on getting indents or something,” he said.
Mackowiak is currently being investigated for medical malpractice.

Sta has signed a convenant with the devils in the names of M’embe and Nchito. DBZ loan must be paid otherwise posterity will judge you harshly. Sata had good lawyers working with him in the names of Obby Mubanga, Mumba Kapumpa etc who have impecable resume’s but why pick on Nchito and Malila. the answer is because of the convenant mentioned above!! Sata is under siege and will continue to look at the smaller picture, Zambia is bigger than M’embe and Nchito. Wake up and be wise Mundala.

I strongly believe the President has grossly overstepped his powers and if he hasn´t then we need to drastically reduce the powers of the President in the constitution. I have no knowledge of these cases or the Judges implicated but this sets a very dangerous and bad precedent. Isn´t it the responsibility of the Chief Justice to institute a commission of inquiry to investigate alleged corruption in the Judiciary? Now any Judge presiding over a case where Government or the PF has a vested interest, will do so with restraint and fear of possible recriminations. Even if the constitution gives him that power the investigation and suspensions should have been instituted via a request to the Chief Justice and the DPP. The President is ill-advised and his cowboy tactics are getting to be very dangerous for our freedom

This is long overdue. Some of us are victims of these judges and are crying for justice to prevail. Thank God he has answered our prayers. Let God expose more of their dealings beyond the stated case. There is circus in civil cases especially in commercial courts. When you have money you get it all. For instance, how can a learned judge fail to distinguish expired contract from existing contract and deny someone leave pay using an expired contract. Why should a judge question and throw out evidence from Interpol just because it exculpates the lesser being. A judge who can’t distinguish an exchange rate loss from collusion deserves the tribune. LET THEM CRY OUR CRIES and EXPERIENCE WHAT WE GO THROUGH WHEN THEY PASS UNFAIR JUDGEMENT. BRAVO MR PRESIDENT.

A point of correction: The high court judge from Malawi is Lovemore Chikopa not Lovemore Chipoka as spelt. He is judge of Mzuzu High Court. By the way on a lighter note he is so famous for delivering rulings against government such that many lawyers who are representing defendants in a government case rush to Mzuzu high court.
