The 14 Billion Kwacha which Mr. Mutembo Nchito and Mr. Fred Mmemba borrowed from Development Bank of Zambia (DBZ) the time were active shareholders in a legal entity called Zambia Airways must be immediately paid back to DBZ, because this is money belongs to Zambians Tax Payers. It is money for the suffering Zambians.
This Funds is invested by the Zambian People at DBZ for National Interest, National Security, and National Infrastructure. The Zambia people have powers to controlled this funds, and they have rights to make checks and balances over this funds, because this Funds is not affiliated to any Political Party, NGO’s or a group of People. The People of Zambia have legal rights to demonstrate or protest if something goes wrong with their monies at DBZ.
However, Judge Mr. Nigel Mutuna who issued a judgment that ordered Director of Public Prosecutors Mr. M. Nchito and Post Owner Mr. F. Mmembe to pay back 14 Billion Kwacha loan the Owed the defunct Zambia Airways acted in accordance within the Rules of Laws of Zambia. It is the duty of Judiciary to maintained Law and Order, and to fights crimes against corruption, frauds and money laundry which has totally destroyed Our Nation pride for the past 21 years. People involved in such activities, should be either thrown in Prisons, or pay back the money to the People of Zambia because we have been left with no any option, and we have been victims of corruption for too long since 1991.
Prisons are built for everyone, not only for poor Zambians, but also for those selfishness thugs busy pocking tax payers money for their personal benefits. Although Our Judiciary System is too rotten, people of Zambia really one day needs to see equal justice applying to every person residing within Our territory. No one should be above the Law.
Moreover , Judge Mr. N. Mutuna’s Order was definitely right because it fails within the Rules of Laws of Zambia, or Bankruptcy Laws Network over disadvantages of Shareholders in some Cases of Companies Liquidation. In this Case, immediately Mr. M. Nchito and Mr. F. Mmemba became active shareholders in a legal entity called Zambia Airways (ZA) – automatically they inherits ZA debts, in times of Company Bankruptcy, Losses or Liquidation.
Therefore, the are no ways Nchito / Mmembe can come Out from this Case as this Issue is straight forwards, because as active shareholder they inherits all debts of ZR. They have just to pay back 14 Billion kwacha to DBZ, and to make the matter more worsen this money belongs to Zambia Tax Payers. And further more, Nchito has to resigned immediately as DPP to pave way for further investigations into this unpaid DBZ Loan which the defunct ZR acquired.

I know that the duo meant well, but might have been forced into this situation by the former government closing up Zambian Airways which was the source of the money to enable Mr. Nchito and Mr. Mmembe to pay back the loan. The workers of that company are still owed four months salaries and other benefits.
Politics is destroying this nation and its time this came to an end. Who suffers in the end?…the grass. Please reverse this trend.

Please ensure to check the articles for spelling and grammah mistakes before publishing them. Further the writer of this article needs to be advised about the concept of limited liabilty for companies. Unless of course the shareholders of Zambian Airways fraudulently obtained monies from DBZ, the liability of shareholders is limited only to the extent of unpaid liability of the shares they hold. As for the Directors they are only personnally liable if, at the time of obtaining the loan from DBZ, they knew or ought to have known that ZA was insolvent and would not be able to repay the loan in the normal course of business. DBZ lent out the monies in the normal course of business i suppose. Someone should clarify these matters lest we debate on matters we have limited information on.

@BCK they did nt borow the money for food but for busness so as long as the company is polically closed for no reason they should not pay regardless of who they owe. ZA should have bn helpd to stand and nt clossing thats lesson to poor politics by MMD, dnt forget that ZA was a limited company with limited liabities so before closing it one should have thought well than hiding in the corrupt judicially. My advice is give them back ZA and force them to pay back 14bn according to the agreement.
