HH Pleads Not Guilty, Granted K30 Million Cash Bail

HAKAINDE Hichilema the leader of United Party for National Development (UPND) who was arrested by Zambia Police Service this morning has pleaded not guilty to the one count of publishing false information to the public.

Facts before the court are that Mr Hichilema on June 11, 2012 at Lusaka did orally publish statements in which he said inter alia that “PF had signed an agreement for the militia in Sudan to train PF youths, prepare for trouble”

“Do you know what is going on in Dafur ?. Do you know what is going on in Abyei? Do you know what is going on there? Killings” Statements which are likely to cause fear or alarm the public.

Mr Hichilema, 50, a Businessman and Politician took plea before Chief Resident Magistrate, Joshua Banda, in the Lusaka magistrates’ court today.

Magistrate Banda granted Mr Hichilema a K 30 million cash bail, with two working sureties based in Lusaka and further ordered that his passport be surrendered to the Senior Clerk of Court.

Mazabuka Central Member of Parliament Garry Nkombo and his Zambezi West counter part Charles Kakoma signed the bail on behalf of the UPND leader.

Mr Hichilema is charged with one count of publication of false news with intent to cause fear and alarm to the public contrary to section 67 (1) (1) of the penal code cap 87 of the laws of Zambia.

Mr Hichilema will appear on September 13 for mention and trial commences on October 1 to 5 this year.

The Zambia Police Service earlier in the morning today formally arrested and charged Mr Hichilema for allegedly publishing false information to the public.

Mr Hichilema arrived at the Zambia Police Service Headquarters at 10:30 hours in the company of his lawyers Sakwiba Sikota, Jack Mwiimbu and Alliance for Democracy and Development President Charles Milupi.

His supporters were however stopped by the police to enter the Service Headquarters.

Mr Hichilema was arrested around 11 hours and was later driven to Woodlands Police station where all the formalities were done.

Mr Hichilema has been arrested in connection with a statement he made on June 11, this year that the ruling Patriotic Front (PF) had signed a Memorandum of Understanding (MoU) with the Sudanese government to train youths in that country as militia.

    PF should prepare for hard times after 2016 elections? It’ll be lack if Ukwa dies b4 tht time cos God is angry wt him, he has abused the people of Zambia. Instead of him ruling he has sold the presidence to Membe and Nchito at k14bn to tarnish his name. I feel for Sata time ahead is rough for him.

    Do you see how many shallow minded people HH is taking with him? Like Storm above! They are so blinded to reason and the truth that they even think Mazoka was killed by his political oponents when it’s public knowledge that it was AIDS that killed him. They lack objectivity and are basing their allegience to HH simply because he is Tonga. The PF government must be commended for taking such bold steps because they have not violated any local or international laws at all. If HH is innocent, then the courts will vindicate him, end of story! Sata must be given a chance to govern even though he has made some blunders. There is no country that will let you go scot free once you make such inflamatory statements that threaten natiaonal peace or development, or deprive the nation of international investment. Do you people understand the threat and implication of HHs statements? Sudan is conssidered a terrorist nation in the Western world. To now tell the world that Zambia has such shoddy dealings with them as HH claims means our international corporation partners will mmediately withhold their support in whatever form thereby restricting the flow of the much needed FDI( Foreign Direct Investment) When the Zammbian people suffer as a result, you blame Sata! HH is even fortunate he got bail. He should have been charged for treason and locked up until his trial commences in October.

    I think the PF has erred here. First of all it was what HH was doing at E Hone college then now his arrest. All this in less than 5 days. They are now using the police to hustle their ‘enemies’. It looks like the Post Newspaper cannot puch enough or what? What cowards! Sad day for our so called PF democracy.

It is just one of the many attempts to shift peopple’s attention from real issues. CNP and his cohorts have so far failed the people of Zambia. Even a 10 year old child can read between the lines.

    In court he will be asked to disclose the source of his info and he will refer to a blog article he may have been told about which may no longer be on the net. His lawyers will say he was commenting on a matter of public interest but the prosecution will insist that the matter was not a comment on a public matter but on a matter bordering on national security and bilateral political relations between Sudan and Zambia. he wil refer to peace keeping missions Zambian troops are sent to and the training they receive. The prosecution will aver that the Zambian troops on peace keeping are sent by UN and for peace keeping only. HH will be warned of the serious implication of peddling and toying with inaccurate security and military matters. Anyway before all this his lawyers may advise him to change his plea from Not guilty to Guilty and the trial Judge may, in the interest of harmony, enter a nolle prosequi……..HH will have learnt a few lessons from this episode nonetheless.

    i am particularly not comfortable with our new best friend(ZIM).

    who said RB had brought soldiers from ZIM prior to last year’s elections? could he prove this?

    But lets wait and see.
