Ndola Boy to Pay K700 for Assaulting 2year Child With Brazier

THE Ndola Magistrate’s Court has slapped a K700 fine on a 17-year-old boy for assaulting a two-year-old child with a brazier.
This is in a case in which the juvenile, a Grade seven pupil of Masala Primary School, is charged with assault.

The boy, on April 24 this year in Ndola, assaulted Mwamba Bwalya.
Magistrate Ben Akende on Monday ordered that K500 be paid to the complainant while K200 should be remitted to the State.
He said in default, an order of distress should be issued against the boy’s guardians.
“This money has to be paid immediately by the juvenile’s parents. If this money is not paid, an order of distress shall be issued.
“Parents nowadays have no direction for their children, they let them do whatever they want without them being involved and this has led to many young people getting entangled in criminal activities,” Mr Akende said.
Facts before the court are that on the fateful day around 13:00 hours, the teenager picked a quarrel with the child’s mother, Justina Chungu, over the water she had drawn from a communal tap.
After Ms Chungu fetched the water, the juvenile placed his feet in the bucket of water and this infuriated Ms Chungu and a quarrel ensued.
“The juvenile picked a brazier and threw it at Ms Chungu but it missed her and instead hit the child on the head,” the facts read in part.
The child sustained a deep cut on the head and was taken to Arthur Davison Children’s Hospital (ADCH), where he was treated.
The juvenile was arrested and detained at Masala Police Station.
In mitigation, the juvenile pleaded for leniency because he is a pupil and he vowed never to commit a similar offence in future.
Social welfare officer Angela Mwanza recommended that the juvenile be placed on one year probation so that he could be counselled.
But Mr Akende said juveniles do not seem to learn their lessons on probation because it is equal to no punishment.
“That is why I am going to fine you so that your guardians can feel it by paying the fine,” Mr Akende said.

    The savage boy should have been caged on top of paying compensation for injuries suffered!

    on top of the fine he should have been charged with community service cleaning toilets weekends and also his record at school should have been checked.
