HH Fails To Appear In Court, Illegally Sold A Farm

UPND Leader Hakainde Hichilema

Opposition UPND leader Hakainde Hichilema has failed to appear in court in a matter in which he is alleged to have illegally sold a farm according to MuviTV News

Mr. Hichilema who has been called as a state witness in the matter is alleged to have bought the farm in question from the administrator of the said property thereby depriving the rightful beneficiaries.

Charity Swana a school teacher at Simon Mwansa Kapwepwe and her brother Enerst Swana Mwanga are jointly charged with an offense of depriving minors of a 210 hectare farm valued at three hundred million kwacha.

The duo is alleged to have on unknown dates but between 1st January, 2004 and December 2004 in Chisamba being administrator and guardian did deprive Boyd Swana Mwanga and Beauty Swana Mwanga of a farm.

The respective farm was a property of the late Jackson Mwanga who died in 1992.

When the matter came up for continued trial state prosecutors informed the court that Mr. Hichilema’s lawyers had sought an adjournment to March 2012.

And Chisamba Magistrate Misozi Banda has adjourned the matter to march 7th, 2012.

    No story here!!! Everyone is at liberty in courts of law to re-schedule their case and the reason the courts adjourned the case as reported.

    And your headline is misleading: “Illegally sold a farm”…..and you say he bought the farm from an Administrator of an estate.

    when buying property from pipo its better to investigate, especially properties that are sold by administrators. Most of them are properties that are held for families of the deceased and are as good as stolen unless the beneficiaries consent to the sale.

    HH may loose out on the property when the courts render the sale null and void. its the same as receiving or buying stolen property.

    Buying buying property illegally is as good as buying stolen property which is a crime. Therefore is charged with being in possession of property alleged to be proceeds of crime e.g former Mines minister. Namwiba ba HH!!!!……. That’s why you are running away….

    Chanda b alot of blog contributors seem to be illiterate where English is concerned. The headline says that Hh sold a piece of land and the article says that he bought the land from the administrators. These two statement in the same article contradict each other. Since the headline is a lie and seriously impacts on the character and reputation of Hh then it would be in Order for Hh to sue tumfweko for defamation and for us readers not to take this website seriously. This site seems to be a tool used by the present government to destroy the opposition and not a objective on that is able to deliver the whole truth and but the truth for the betterment of Zambia. Maybe it is true that this paper is Bemba and it hates tongas. I used to doubt that thought but with each passing day this site seems to prove me wrong and become more of a tonga-hater one.

U claim to be educated and an Accountant for that matter, u failed to do diligence work of ascertaining whether the property was not encumbered whether U ve billions or trillions this only shows that U a chancer, fyonse fya kupyana! things left by the dead! even a lay man like me B4 i buy a car from some1 I ve to verify the papers 1st by going to RATSA then buy the car if they certify that there is no claim on the car. Uku ekufwaya ukulila abana banshiwa. What a leader aspiring to lead this Great Country. Shemuna Shemu! Any1 supporting this man deeds needs brain sugery period.     When we say that HH is a crook Tongas get very angry and ugly in the process. We know that HH did not steal the land but what we are concerned with is a presidential candidate buying property that is illegally sold by selfish administrators depriving that property from the rightful owners. HH is aspiring presidential candidate and should be seen to protect the rights of every citizen especially those who lost parents. buying something stolen or illegally sold is theft and therefore the contract is VOID.

    Hate Hate. He bought it because it was cheap and he knew there were minors who where the future owners of the farm. Fro experience and for a person aspiring to be a leader he should have been considerate of the those minors because defiantly he knew that the sellers were just administrators the real owners were still very young to enter in to a transaction.     This land was advertised and HH bought the land based on that. The people in trouble are the ones who sold the land to him.. in fact the administrator is the one who sold and anyone can buy land from the administrator.in fact he sent his lawyer to represent him over this small matter i wonder why the unlearned judge cannot allow the lawyer to represent HH.Is it another political manipulation coming in…kikikikiki.

    This case is still in court we have not heard from the other side lets wait 4 the would be presdo defend himself over this allegation or issue, looking at HH I do not think is a person who would buy such a property like land without following the rightful procedures when a land is being sold there must be papers of ownership like a title deed which is bearing the name of the occupier from there that is when you make inquiries, how did you come to own this land since the title deed is bearing another name find out who are the rightful owners. The same thing happened to our family after we lost my cousin, one of her children sold the house without the knowledge of other children, the case was taken to court by other children they won the case and the house was retained to the children, so the man who bought the house sued the child for his money by then the child had chewed all the money, this child was locked up for 2 yrs for failing to pay back the money.

    The story is straight forward. HH bought that land from the administrator and later sold it to someone else. This son of the soil HH chigili has no case to answer and was supposed to appear in court as state witness.

    When some one passes on they are to leave an inheritance for their children, not for their brothers and sisters/parents. Can we learn to work hard for our own things instead of always waiting for someone to die so that we can steal from their kids.Some of us in Zambia are like that, lazy and selfish, feeling as though we are more entitled to our relatives’s possesions than their chilren.

    NOTHING WRONG IN THE SALE,IF THE SELLERS SOLD BECAUSE THE CHILDREN OF THE LATE WERE MINORS THEN THE SALE VERY LEGAL.

    The law of zambia is very clear on this one; buying stolen property is a crime, besides we are a christian nation anyone vying to be president of zambia should abide by christian values; the bible commands us to look after orphans and widows and protect their rights, chapwa.
